Enforce Fairfax County Noise Ordinance at FCPS High Schools, especially West Potomac
The Issue
THE PROBLEM
The noise levels at high schools in Fairfax County, Virginia, particularly at West Potomac High School, have become a significant concern for community members. Sounds exceeding decibel limits originating from loud speakers during school events and musical instruments during band practices throughout the year, have persisted for years without remedy, despite raising concerns to school and FCPS officials, negatively impacting the community's quality of life.
BACKGROUND
The Fairfax County Noise Ordinance exists because the Fairfax County Board of Supervisors found and declared that certain noise is a hazard to the public health, welfare, peace and safety and the quality of life of the citizens of Fairfax County; that the people have a right to and should be ensured of an environment free from sound that jeopardizes the public health, welfare, peace and safety or degrades the quality of life; and that it is the policy of the Board to prevent such noise to the extent such action is not inconsistent with Federal or State law.
While schools enjoy some exemption under the Fairfax County Noise Ordinance, certain sounds have been found by the Board to infringe on the quality of life of the citizens of Fairfax County. In particular while Section 108.1-5-1(r) excludes activity on recreational grounds (ex. Schools) customarily associated with its intended use from the Noise Ordinance, the Noise Ordinance does however make it explicitly clear that “The use of loudspeakers or instruments associated with such activities shall be prohibited between 10 p.m. and 7 a.m. and shall be subject to the Maximum Sound Levels Table in Section 108-1.4.2 between 7 a.m. and 10 p.m.” In other words, just because loudspeaker or instrument sound originates from recreational grounds (I.e school property) and is customarily associated with its intended use doesn’t give the originators of the sound blanket exemption from the Fairfax County Noise Ordinance. The noise from loudspeakers and instruments (regardless of its source) SHALL be subject to maximum sound levels during daytime hours 7 a.m. - 10 p.m.
THE NEGATIVE IMPACT
At West Potomac High School the lack of effective noise regulations and enforcement has resulted in a challenging atmosphere for families and other FCPS students who live close by. Noise pollution from West Potomac has been linked to decreased academic performance, heightened stress levels, emotional distress, wasted time addressing the issue with school and FCPS officials, and even health issues such as sleep disturbances. Communities surrounding West Potomac have been affected by the unneighborly loud noise, which extends beyond school hours and into late evenings. Residents report difficulties in enjoying their home environment, as noise from school activities interferes with their peace and tranquility, family dinners, and bedtime routines particularly during school events and band practices. Additionally, there are multiple studies linking noise to public health risks that can impair brain functions and increase susceptibility to mental health disorders (e.g., anxiety, depression, and behavioral issues) through stress-related biological and psychological mechanisms. THE FIX
Fairfax County Public Schools must take immediate action to address these issues by enforcing decibel limits of loudspeakers and instruments pursuant to the Maximum Sound Levels Table found in Section 108.1-4-2 of the Fairfax County Noise Ordinance, especially between the hours of 7am and 10pm due to it’s heightened risk of infraction during this time period.
We propose the implementation of consistent noise monitoring and regulation at all Fairfax County High Schools, especially West Potomac. This includes adhering to decibel level limits for various activities during and after school hours. Installing sound barriers at school property perimeter and using noise-reducing materials in construction and maintenance work will also help mitigate noise levels. Ensuring specific areas on school property are used for their intended purpose (ex. entrances for entering and exiting buildings, parking lots for parking cars, football fields for football and band rooms for band practice) will help align with expectations from the community as to where sound should originate from on school property.
SUMMARY
By prioritizing student welfare and community well-being, Fairfax County Public Schools can foster a healthy and supportive educational atmosphere and neighborhood in and around their High Schools. We urge the school district to collaborate with environmental and community experts to design an effective noise control plan that balances school activities with community peace.
