Residents of Gary-New Duluth, especially children, seniors, and those with mobility challenges, are affected by the current vehicle placement practices of New Auto Duluth. Pedestrians often need to navigate around vehicles parked close to sidewalks, sometimes creating situations where people must walk in the street. Families living nearby have experienced changes to the residential character of their neighborhood as vehicles occupy multiple lots and neighboring properties. Our small community's appearance and safety have been affected as this business has expanded its operations.

What is at stake?

If this situation continues without proper oversight, we risk gradually changing the character of Gary-New Duluth from a residential community to an area with excessive commercial presence. Property values may be affected as the visual appeal of our neighborhood changes. More importantly, potential safety concerns exist for our residents, particularly children walking to school and elderly neighbors who need safe, accessible sidewalks. This situation raises questions about consistent enforcement of Duluth's zoning regulations across all neighborhoods. The dealership appears to be operating in ways that may not fully comply with Duluth City Code Chapter 50 (sections 50-14, 50-25, and 50-30) and Minnesota State Statute 169.34 regarding sidewalk access.

Why is now the time to act?

The situation has gradually developed as the dealership has expanded its inventory. Spring and summer bring increased pedestrian activity to our neighborhood, including families with young children, making sidewalk accessibility especially important. Community members have attempted to address these concerns through appropriate channels without achieving the desired results. The City of Duluth has regulations in place to ensure both business success and community standards – we're simply asking for consistent application of these existing rules.

We, the undersigned residents and supporters of Gary-New Duluth, request that the City of Duluth:

  • Conduct an inspection of the dealership for code compliance
  • Address any identified issues regarding vehicle display, setbacks, and landscaping
  • Work with the business to develop a reasonable plan for any necessary adjustments
  • Ensure proper access to pedestrian walkways and public rights-of-way
  • Apply the same standards to this business as other Duluth businesses

We support responsible business development in our neighborhood. We simply ask that all businesses adhere to established codes and ordinances that protect neighborhood character, pedestrian safety, and property values.
