End the 'black box' of hiring for California applicants
The Issue
The Problem: The Silent Rejection.
Thousands of Californians, from recent graduates to experienced veterans, are currently facing a broken hiring system. After weeks of interviews and hours of unpaid take-home assignments, candidates are often met with total silence or generic rejection templates.
This “black box” hiring process causes real harm:
- No Growth: Without specific feedback, candidates (especially those entering the workforce) cannot learn what skills to improve.
- Wasted Potential: Talented individuals remain unemployed longer because they are guessing at their mistakes.
- Lack of Accountability: The "black box" allows companies to hide potential bias or discrimination behind vague rejections.
The Solution: The Candidate Feedback Transparency Act.
We are calling on Governor Gavin Newsom and the State Legislature to enact a law requiring the following:
- Mandatory Feedback: Companies must provide a minimum of one paragraph (3–5 sentences) of specific, constructive feedback to any candidate who completes a final-round interview.
- Constructive Criticism: Feedback must clarify whether the rejection was due to a technical skill gap, cultural fit, or lack of specific experience.
- Limited Scope: This requirement applies only to final-round candidates, where the investment of time and labor is substantial.
The Safeguard: Protecting Companies (The Waiver) We understand that companies fear litigation. To make this law viable, we propose a "Safe Harbor" provision:
- The Feedback Waiver: Candidates can opt to sign a waiver before receiving feedback, agreeing not to sue based on the content of the feedback, provided it is given in good faith and is non-discriminatory.
- Honesty without Fear: This ensures companies can be honest and helpful without fear of legal retaliation.
Why California Must Lead
California sets the standard for innovation, labor rights, and economic leadership. Transparent hiring is not radical; it is respectful, efficient, and aligned with a modern workforce.
