The Issue

We, the undersigned, call upon the Regional Trial Court (RTC) Branch 66 of San Fernando, La Union to immediately lift the Temporary Restraining Order (TRO) against the Metro San Fernando Water District’s (MSFWD) decision to terminate its Joint Venture Agreement (JVA) with PrimeWater Infrastructure Corporation. This decision to freeze the termination of the JVA is a direct violation of the rights of over 22 barangays across San Fernando, Bauang, Bacnotan, and San Juan, who have suffered from PrimeWater’s failure to provide reliable, affordable, and quality water service.

PrimeWater’s decade-long record is one of neglect, with frequent water interruptions, unresponsiveness to customer complaints, excessive rates, and a consistent failure to fulfill its obligations. Despite being given ample time to address widespread issues, PrimeWater failed to respond or improve services, leading to the MSFWD Board’s justified decision to end the contract on May 8, 2025, and resume public control over water services.

However, the TRO issued by RTC Branch 66 halts the MSFWD’s critical efforts to repair infrastructure, develop new water sources, and restore public control over water services. As a result, thousands of residents are left at the mercy of PrimeWater’s failing system, while their basic human right to water is compromised.

We demand that:

  1. RTC Branch 66 upholds the rights of consumers and immediately lifts the TRO against the MSFWD’s decision to terminate the JVA with PrimeWater.
  2. Government institutions stand with the people, not with profit-driven conglomerates like PrimeWater, and support public, community-centered alternatives to water privatization.
  3. PrimeWater’s exploitative contracts with water districts across the country be investigated and terminated, with the government holding the company accountable for its poor services and violations.
  4. We call for immediate action from the Local Water Utilities Administration, Congress, and the Senate to protect consumers from corporate abuse and advance policies that prioritize people over profit.
