

End Parental Alienation & Reform Family Court Laws in Massachusetts
The Issue
Protect Our Children, Strengthen Parental Rights, and Ensure Fairness in Family Court
To: The Massachusetts Legislature, Governor, and Family Court Systems
Children deserve the love and guidance of both parents, yet parental alienation—a form of psychological and emotional abuse—is being ignored in family courts. Parents are manipulating legal systems to cut off the other parent, using false allegations, interference with custody orders, and emotional coercion to damage children’s relationships with their loving parents.
Too often, this issue is dismissed by judges, attorneys, and family court professionals who lack training in recognizing alienation, bias, and manipulation. This results in parents losing access to their children unfairly, leading to long-term emotional and psychological harm for the child.
We Stand for the Following Legal Reforms in Massachusetts:
- Recognize Parental Alienation as Emotional & Psychological Abuse – Add it to Massachusetts child abuse statutes and include it in DCF (Department of Children & Families) investigations.
- Mandate Training for Family Court Professionals – Require judges, GALs, attorneys, and DCF caseworkers to receive training on parental alienation, emotional abuse, mental health issues and racial bias.
- Stronger Enforcement of Custody Orders – Parents who ignore court orders, block communication, or manipulate custody arrangements should face legal consequences.
- Require Independent Mental Health Evaluations – Court-ordered therapists must be neutral professionals, not handpicked by one parent.
- Ensure Racial & Cultural Competency in Family Court – All professionals handling custody cases involving children of color must receive cultural competency training to prevent bias and systemic discrimination.
- Assign an Equity Caseworker in Cases Involving Minority Families – This role will ensure fairness, cultural awareness, and equitable solutions for all parties involved, preventing systemic biases from impacting custody decisions.
- Mandate Mental Health Assessments – Require professional evaluations with a comprehensive understanding of therapy settings, family history, pharmacological and substance use. These assessments should include insight into the long-term effects of psychiatric medications and other substances, potential side effects, and their impact on parenting capacity. Courts should consider medication-related behavioral concerns in custody and co-parenting proceedings to ensure the children's well-being is not compromised.
- Mediation in Divorce, Estate, and Child Custody Matters – Require structured mediation, including co-parenting mediation, to ensure that legal decisions are made in the best interest of children and families rather than through adversarial legal battles that escalate conflict and cause emotional harm.
Why This Matters: Parental alienation destroys lives. Studies show that children who experience alienation suffer from depression, anxiety, low self-esteem, and difficulty forming healthy relationships as adults. No child should be forced to choose between parents due to manipulation and control.
We are calling on Massachusetts lawmakers to take immediate action to protect children, enforce fair custody decisions, and hold alienating parents accountable.
Several states already recognize parental alienation as a factor in custody disputes or classify it as emotional abuse, including:
Texas – Courts recognize parental alienation and have ruled against parents who engage in it.
California – Parental alienation can be considered a form of emotional child abuse in custody cases.
Florida – Family courts have acknowledged alienation as a tactic used to manipulate children against the other parent.
Illinois – Courts have ruled that alienation is damaging to children and can impact custody decisions.
Ohio – Parental alienation has been cited as a significant factor in modifying custody orders.
West Virginia – Recognized parental alienation as a form of child abuse that harms the child’s well-being.
Kentucky – A law was passed promoting equal shared parenting to help prevent alienation.
Arizona – Courts have explicitly considered parental alienation in determining the best interests of the child.
