End Inequality in Divorce Proceedings: Allow People to Reclaim Their Birth Surname

The Issue

We, the concerned citizens of the United Kingdom, call upon the government to address a glaring gender inequality issue within divorce processes. Currently, people (largely but not exclusively women) who adopt their partners surname upon marriage and find themselves in a lengthy divorce process are forced to go through a costly and unnecessary deed poll process to reclaim their birth surname.

I’ve spent the last three and a half years attempting to get a divorce. It’s been the most emotionally challenging and frustrating process I’ve ever been involved in, and without a decree absolute, the only way I can change my name back to my maiden name and reclaim some sort of ownership over my life is to go through a deed poll process. The whole process is archaic, and assumes that marriage permanently alters a persons identity, while the other party is free from such constraints. It’s become a huge goal for me and if I can help other people avoid the same stress and pain, it’s worth it. 

This outdated requirement not only perpetuates gender discrimination as the vast majority of affected individuals are women, but it also places an undue burden on those seeking to exercise their right to choose their own identity, an identity which they were born with and legally identified as in their birth certificate.

The current legislation disregards the principles of equality and personal autonomy enshrined in modern society. It undermines progress made towards gender equality by reinforcing traditional patriarchal norms that view women as property or extensions of their husbands. 

Supporters of this petition believe it is essential for our legal system to reflect societal changes and promote fairness between genders. By eliminating the requirement for people to undergo a deed poll process when reclaiming their birth surname after divorce, we can take significant steps towards achieving true gender equality in the United Kingdom.
