Enact ERISA Reform
We the undersigned individuals demand the reform of ERISA Preemption so that individuals who obtain their medical or disability insurance through their workplace are afforded the same protections under the laws of their states as do those who obtain their insurance individually.
We, the undersigned, demand Congress and the President enact ERISA Reform. This is a serious issue affecting millions of employed Americans and their families.
Unfair insurance practice regulation in the United States is normally handled by the states - through state insurance departments, state insurance laws and state court decisions. There are NO federal insurance regulations and, in fact, the federal government is prohibited from regulating insurance.
Yet, a US Supreme Court Decision ruled that all state insurance laws are voided in cases where the insurance was purchased through the workplace. Because of this Decision the millions of Americans who obtain their health and disability insurance through their employer, and their families, have lost ALL of their rights and protections under the insurance laws of their states.
Based on this decision insurance policyholders can be, and often are cheated by their insurance company through the fraudulent denial of legitimate claims. This is so - even for seriously ill or disabled individuals. Without the protection of their state's unfair claims practices laws, there is nothing they can do about it.
In 2006 I met with then Senator Obama in his office in Washington DC about a book I had written about this problem. The book, Insult to Injury, was endorsed by Senator Ted Kennedy, Insurance Commissioner John Garamendi and other public officials. It described this problem, which is known as "ERISA Preemption," and called for immediate reform.
Senator Obama promised to lead the campaign to change this. Due to the lack of public awareness of this problem, he has not done so.
The purpose of this petition drive is to increase public attention to this situation.
