West Hills Concerned Citizens is a group of residents, business owners, and others that have a stake in the day to day events that take place in West Hills, California.

We are a group of people that have been treated unfairly and have been denied access to information concerning our community by the West Hills Neighborhood Council President, Daniel Brin.

We beleive that Mr. Brin has used his authority in an abusive manner and refuses to separate his personal Facebook account from his official duties as the WHNC President as evidenced by the many screen shots contained in this communication.

Mr. Brin is an administrator of the West Hills, California community Facebook group. This group has more than 17,000 members. Mr. Brin claims that the Facebook group has no affiliation with the neighborhood council and states in the description of his page that “This group is NOT an agency, organ or subsidiary of the West Hills Neighborhood Council nor any other organization public or private. Opinions expressed by any of the administrators are his alone unless otherwise stated by him.” Yet, more official neighborhood council business is conducted on the pages of this neighborhood Facebook page which Mr. Brin refers to as an ‘exclusive club’, than is conducted on the official West Hills Neighborhood Council page.

Mr. Brin, an elected public official, we feel is derelict in his duties as a civil servant and acts in an unjust and unfair manner by either personally blocking or removing members of the community from his neighborhood page that state political opinions that he disagrees with personally. This behavior is a gross infringement on the First Amendment rights of Mr. Brin’s constituents.

Because Mr. Brin is an administrator on his neighborhood ‘exclusive club’ and discusses local neighborhood issues that are a part of neighborhood council discourse, we believe Mr. Brin has an obligation (perhaps a legal obligation based on recent court decisions) to unblock and admit those that he has kicked out of his neighborhood page so that those who wish to engage him in political discourse or to simply state one’s opinion on any number of political threads on his neighborhood page have the opportunity under the First Amendment to do so.

In addition to the constitutional issues presented, there are several stakeholders that have been removed from the neighborhood page whose incomes are dependent on networking with other stakeholders in the community.

We feel that Mr. Brin is at the root of these issues and we respectfully request that Mr. Brin’s abuse of authority be investigated and given the attention that it deserves. We respectfully request the following:

1. All West Hills stakeholders personally blocked by Mr. Brin be immediately unblocked.
2. All West Hills stakeholders that have been removed from the West Hills, California neighborhood Facebook page be immediately reinstated.
3. Instructions on what the proper procedure is to initiate a recall of Mr. Brin for his abuse of authority as both President of the West Hills Neighborhood Council and administrator of the West Hills, California neighborhood Facebook page.
