Hi everyone,

 

I hope this message finds you well. I wanted to provide you with an important update regarding the #ElliesFightForFreedom_NI campaign, which has been challenging the NHSCT with the incredible support from Nicholas Quinn Solicitors - Children's Law Specialists . After exploring every possible alternative and receiving no satisfactory answers from the trust, with the DOH refusing to get involved, we submitted a pre-action to judicial review last November and had no response to any of the issues addressed. We have our paperwork ready and waiting to lodge in the High Court.

 

The trust has this week responded to say they WILL PERMIT delegated nursing tasks with appropriate training.

 

However, it is worth noting that all our staff have already undergone this training and we have all the appropriate insurance in place. This raises significant questions about the legality and ethics of their actions towards us and similar families. 

 

We strongly believe that what they did was unlawful and unethical, and that they had no grounds to do so. We are committed to standing up for what is right and will continue to fight to ensure that legislation is amended to reflect changes in direct payment and allowing delegated nursing tasks without refusal.

 

This amendment will be invaluable to thousands of families, enabling them to bring loved ones home from hospital and receive care at home according to their own agenda, rather than that of the trust or an agency. It will also provide much-needed respite for families like ours, who have no alternative provision.

 

Our fight will continue to make this lawful and ensure that no trust can repeat these catastrophic actions enforced on my family. If they fail to provide written evidence that this is the case, the judicial review and more will land on their doorstep at the end of this month. 

 

We are grateful for the nearly 20,000 signatures supporting us and the support from Carol Jordan and Una Culkin in publicising our campaign. Additionally, I will continue to push alongside MLA Claire Sugden , Caoimhe Archibald MLA , and Nuala McAllister MLA to create a pathway for all in Northern Ireland. And to Calebs Cause NI for all your help and assistance.
