Eliminate "Knowingly" from NC Domestic Violence Violation Laws to Enhance Victim Safety
The Issue
As a survivor of domestic violence, my life was riddled with fear and distress due to the relentless calls and texts from my abuser, despite having active Domestic Violence Protection Orders (DVPO) in place. The violations were multiple, yet the court dismissed them on the grounds of accidental or misunderstanding, even with documents and pictures proving the violations existed.
This loophole in the law has had serious consequences for me and countless others, impacting our mental health and causing us to live in a constant state of fear and mental distress. In North Carolina, current legislation allows violators to escape punishment for violating a Protective Order by using the word "knowingly". Under this loose interpretation, supposed offenders can easily claim an error or that the communication was intended for someone else. In essence, this gives them the means to continue their torment of victims.
It's estimated that 1 in 3 women and 1 in 4 men have experienced some form of physical violence by an intimate partner ("The National Domestic Violence Hotline Practices and Research"). This alarming statistic, coupled with my personal experience, underpins the urgency of this call for change.
We, the victims, survivors, and advocates against domestic violence, urge the lawmakers and legal entities to remove the phrase "knowingly” violate from the current DVPO law. This change will fortify the legal safeguards for victims and ensure that those who violate such orders face appropriate punishment.
