The Issue
Dear Kathy Hochul I’m writing this request for early release for executive clemency. This request is being made in a form of commutation of sentence. Let me explain who I’am my name is Terrance Daniels ,and I’m currently 31 years young serving a sentence to 20 years of life . I’ve been Incarcerated since I was 17 years young for the charges of murder in the 2nd degree and criminal possession of a weapon in the 2nd degree. I was born in Brooklyn New York and also spent Significant amount of time in the Bronx.The teenager I was,entering the prison system is not the same person I am today.That person who came to prison in 2009 is totally unfamiliar to me as an adult today.
Iam one of four siblings that was raised by mother Tonya coles, grandmother Rebecca Daniels , Aunt Patricia lightly and my late grandfather Howard Daniels. My biological father Terrance Coles wasn’t involved or active in my life, but my step father James black SR helped for filled the role of a parent.Growing up in a matriarch type of household ,hard work and education, along with family oriented was distill in me.As a child school always been a form of escapism for me ,so making friends and learning has never been a problem for me,but I always gravitated towards other kids who was fatherless, poverty stricken, and plague by family members who was incarcerated.Both of my mother only brothers was inconsiderate since i’ve have Been bought to this world ,and both was Release by the year 2008. so a lack of positive male role models was a reason I looked up to my pairs and Sought Validation from them.
In despite of the dysfunctional household negative activities was present in my neighborhood, I still managed to graduate from the 8th grade and have a few credit short of completing high school. I always had aspiration of helping people and caring for them so I decided to major in becoming a cardiologist.This dream stemmed from the crisis of me losing my grandfather to a heart attack, and I wanted to prevent other people to succumbing to the same fate.Helping people always was a trait I displayed since my younger years but lack of anger control ,drug using , and Constantly problems in the street life style along with gang banging slowly lead to poor decisions.Eventually this lead me to goin to prison at a young age.
Since I been incarcerated I never had the opportunity to be treated as a teenager I was at 17 years young . I was charged as an adult and sent to a maximum correctional facility to serve a sentence of 20 years to life. The way I was treated with this harsh punishment was as if I’m irredeemable and would not change. Over the past few years with new incredible pseudo-science information on how significant parts of the brain that there was decision making, impulsiveness,and other vital factors wasn’t considered in my case.If I was given an opportunity to demonstrate how my emotional immaturity lead to a poor decision of takin MR Chisolm life, I would have never been given so much time to serve in an Adult prison setting. Through out my incarceration I have shown a level of growth, accountability, and factors of not reoffending.
I humbly request for u to consider this petition for early release or Immediate release. This commutation would be in the interest of justice, consistent with public safety, and the rehabilitation of petitioner Daniels. My family and community support of volunteer of exodus transitional program will assist me in my release. My Intuitional record is not extensive, mandatory program of rehabilitation been completed, voluntary service has been met along with other accomplishments such as youth assistance program (y.a.p), parenting costs from the Osbourne Association , paralegal course that’s equivalent to a law clerk, locational titles which translate into a work force job. I have a low recidivism rate of returning back to prison if Release, because of my family support that awakes me, that includes housing ,employability, and encouraging to stay positive. If being Monitored via ankle bracelet or post release supervision is your decision, I’m fine with that.
A germane question, is prisoners who had Demonstrated rehabilitation and have consistently proven how their transformation can contribute to Society,Should they be granted early release or Immediate release? The focal point of this petition is determining wether prisoners like myself to be considered immediately. In the year 2019, when I became eligible for executive Clemency, I participated and Completed a transitional program called exodus ,with specialize and changing and restoring hope to those re-entering Society. This highly recommended program Is ran by A former a prisoner name Julio medina. Exodus have a youth program which empowered at risk youth And which I have almost 10 years in experience which I participated At Green Haven correctional facility located in the Hudson valley region. I will have the supportive Services from the stuff at this program along with other Community partnership unit. If I’m giving the opportunity to parole upon release to New York City either with my wife Erica Daniels or my mother Tonya Coles.I have all the skills experience and resources which will make me more Affective as an youth mentor, creditable messenger, contract coach ,in a re entry staff at exodus.
As I mentioned earlier in my petition, I been Incarcerated since I was 17 years young . During my sentences there was certain factors that was not considered, such as me being immature emotionally and my level of impulse control. These factors played a vital role in me making that one poor decision that alter my life forever in Mr chisolm family. What I believe need to change is the amount of time a teenager serves in order to be rehabilitated and reform. As a neuro science evolved and shape how much time a youth serves in prison, I Consistently showed I have a entry plan structure, a history of efficiency work ethic before prison and while in prison.
If I’m granted a second chance to return to society at the age of 31 years young, I know I will succeed . I have Accomplish so many goals , Acquired skills that can translate into the workforce which will keep me employed and focus. Let me explain what I have Accomplish through out my 13 years of being Incarcerated and which I will be an asset to any community, work environment, company, etc With in my first few years Under D.O.C.C.S custody, I resided at Elmira Correction facility,where I was a machine molder operator. I maintain this job as a general laborer for about two years making man hold caps for the street of New York states. Under supervision by industrial training staff, I received numerous evaluation along with recommendations of my work effort, punctuality, good attitude and the ability to work as a team. Im fully aware of felony friendly companies that give second chances and can use a general laborer/helper like myself.
During my time at green heaven correction facility is where I obtained most of my experience and becoming a better young Adult. The main reason why, I was peaking into my mid 20’s And I aloud myself to grow mentally and develop Maturely. At this facility I participated and volunteered in a youth assistance program and this is where I also redefine myself as a young Adult. A lot of the at risk youth I sat down with and converse with about my poor decision making, negative peer pressure that I aloud from my friends, and bad Experience with drugs. It was so many kids,myself an co prisoners helped and influence to steer them on the right and straight path,Many sent letters through their teachers and Chaperones to express their gratitude of the program . I participated in theses group sections 4 times out of the month for almost a decade, And not only was it therapeutic for them but for myself as well. Some of these participants was correctional officers children,nieces,nephews, as well as impatient drug users from Connecticut Rehabilitation program. overall my experience as a credible messenger I can be used efficiently to help those teenagers who are at risk like myself when I was a teenager.
Through out my Incarceration I also sought to expand my knowledge in different work environments in the industrial department. I truly understand how important maintaining employment to remain successful in Society. My main occupation was a panel saw operator in the desk shop where I cut wood which was ultimately built to be used in work offices, school buildings etc. Prior to leaving G.H.C.F I was employed at the industry warehouse department in here I worked as a clerk where I handle merchandise orders, shipped and received materials efficiently ,arranged shipment to different companies, and checked records and made sure everything went Smooth how it should. If im giving the chance to be hired by places like Hanes, walmart? Amazon, men warehouse ,and ikea. with my years while working while incarcerated I have a better chance to remain in society and not return to prison.
Two other accolades I received at this facility was achieving my law library clerk/ Paralegal certificate. During the cost of two months I Familiarize myself with the basic legal writing and researching, Shepardizing case law and Litigating the history of criminal law. For 9 months I Facilitated I highly Beneficial program called Aggression replacement training (A.R.T ). For years I dealt with anger problems and didn’t Improperly channel my frustration I was dealing with. so after years of growing maturely I was able to help other prisoners of all ages To maintain 6 weeks of consistent Attendance, Acquire life skills, practical moral Dilemmas , and learn how to replace their anger Probably with problems solving. The little bit of time I taught this Mandatory programs for those with Violent behavior, I also shared my experience of not having my biological father present in my child hood,This left me Emotionally imbalance and immature . It wasn’t until I was about 27 years young until I finally forgave him. In the year 2019 I met him for the first time in a very long time and now my life would be always and forever changed. He was one of the pieces of why my life was incomplete and why I made a lot of my poor decisions. Now that he’s back in my life and I’m much more mature and wiser and my life has been restructured .So Governor Hochul , if I’m granted a second chance to be release early by Commutation of sentence, I would prove that I can be a law Abiding Citizen , A reliable worker ,A good decision maker, And a asset to any community. With the support I have around me will only ensured my chances of remaining in Society. So please consider my petition and grant Clemency for Terrance Daniels.
