Met deze brief geven wij uiting aan onze afkeuring van het in januari 2022 gemelde besluit van de Nederlandse regering om haar financiële steun in te trekken aan de Union of Agricultural Work Committees (UAWC), een Palestijnse organisatie die actief is in de bezette gebieden van de Westelijke Jordaanoever en Gaza. Dit besluit komt op een moment dat de gehele sector van Palestijnse maatschappelijke organisaties ernstig wordt bedreigd.

In November 2021 heeft het Israëlische leger bij militair bevel het UAWC en vijf andere Palestijnse groepen die actief zijn op het gebied van mensenrechten, cultuur en arbeidsrechten als "terroristische organisaties" bestempeld. Deze beschuldigingen werden aangekondigd zonder dat er enig bewijs voor werd geleverd. Nadat tal van Palestijnse, Israëlische en internationale NGO's, alsook de Zuid-Afrikaanse regering en de Hoge Commissaris voor de Mensenrechten van de VN, Michelle Bachelet, dit militaire bevel hadden veroordeeld, hebben VN-mensenrechtendeskundigen het besluit bestempeld als "een frontale aanval op de Palestijnse mensenrechtenbeweging, en op de mensenrechten overal". De beroemde Zuid-Afrikaanse professor in de rechten John Dugard, die het besluit eveneens heeft veroordeeld, maakte de vergelijking met de behandeling van mensenrechtenorganisaties door het Zuid-Afrikaanse apartheidsregime in de jaren '80 van de vorige eeuw.

Door de financiering van het UAWC in te trekken, heeft de Nederlandse regering Palestijnse NGO's, en het UAWC in het bijzonder, zeer kwetsbaar gemaakt voor verdere druk door de Israëlische staat. Het besluit is in strijd met de verplichtingen die de Nederlandse regering heeft tegenover mensenrechtenactivisten. Het is ook in strijd met de verantwoordelijkheid van de Nederlandse regering om toe te zien op de naleving van het internationaal recht, zoals het Internationaal Gerechtshof heeft bevestigd in een kritisch advies in 2004, gericht aan de Verenigde Naties en de bredere internationale gemeenschap. Overeenkomstig talrijke resoluties van de VN-Veiligheidsraad, waarvan resolutie 2334 uit 2016 de meest recente zijn, omvatten deze verplichtingen onder andere het beëindigen van de militaire bezetting van de Palestijnse gebieden en het ter verantwoording roepen van de Israëlische staat voor haar dagelijkse mensenrechtenschendingen tegenover Palestijnen.

Het besluit van de Nederlandse regering is genomen ondanks het totale gebrek aan ook maar enig bewijs dat het UAWC in verband kan brengen met gewapende groeperingen. Dit is ook bevestigd door een onafhankelijk onderzoek, uitgevoerd in opdracht van de Nederlandse regering.

De intrekking van de financiering vormt bovendien een bedreiging voor het cruciale werk van het UAWC ter ondersteuning van de plattelandseconomie en de agrarische sector in de Palestijnse gebieden. De missie van de organisatie is het ondersteunen van kleine boeren en gemeenschapsvorming in de bezette gebieden. Dit werk is van cruciaal belang voor de Palestijnse samenleving. De landbouw zorgt voor ongeveer 15% van de werkgelegenheid in de Palestijnse economie en garandeert een zekere mate van voedselsoevereiniteit voor gemeenschappen die met oorlog en bezetting te maken hebben. Op de Westelijke Jordaanoever worden Palestijnse kleine boeren regelmatig met geweld aangevallen door Israëlische kolonisten en het Israëlische leger, die samenspannen om zich Palestijns land en hulpbronnen toe te eigenen. Deze nijpende situatie onderstreept het belang van het werk van het UAWC en illustreert de schrijnende gevolgen van het besluit van de Nederlandse regering om haar financiering in te trekken.

Wij doen dus een beroep op de regering om dit besluit in te trekken en haar verantwoordelijkheden onder het internationaal recht tegenover organisaties als het UAWC en andere Palestijnse maatschappelijke organisaties na te komen. Wij vragen de Nederlandse regering te luisteren naar de oproep van het UAWC, die hun grote bezorgdheid over het besluit in een recente verklaring als volgt verwoordden: "Op dit kritieke moment roepen wij andere donoren op om hun steun aan het UAWC en alle Palestijnse maatschappelijke organisaties te handhaven en te verhogen. Laat ons niet in de steek."

We condemn the decision by the Dutch government, which was reported in January 2022, to cease its financial aid to the Union of Agricultural Work Committees (UAWC), a Palestinian organisation operating in the occupied territories of the West Bank and Gaza. This decision comes at a time when the entire Palestinian civil society sector is under dire threat.

In November 2021, the Israeli military designated, by way of military order, UAWC and five other Palestinian groups that work in the field of human rights, culture and labour rights as “terrorist organisations”. These designations were made without providing any evidence to support these allegations. Following condemnations of this military order by numerous Palestinian, Israeli and international NGOs as well as the South African government and UN High Commissioner for Human Rights Michelle Bachelet, UN human rights experts slammed the decision as “a frontal attack on the Palestinian human rights movement, and on human rights everywhere.” The celebrated South African law professor John Dugard, who has also condemned the designated, recalled the similar treatment of human rights organizations by South Africa’s apartheid regime in the 1980s.

By withdrawing funding for the UAWC, the Dutch government has left Palestinian NGOs and the UAWC in particular highly vulnerable to further pressure by the Israeli state. The decision is contrary to the Dutch government’s obligations to human rights defenders. It is also contrary to the Dutch government’s responsibility to ensure compliance with international law, as affirmed by the International Court of Justice in a critical Advisory Opinion in 2004 that was addressed to the United Nations and broader international community. In accordance with numerous UN Security Council Resolutions, the most recent being Resolution 2334 of 2016, these obligations include bringing an end the military occupation of Palestinian territories and to hold the Israeli state to account for its daily human rights abuses that it inflicts on the Palestinian people,

The Dutch government’s decision was made despite the absence of any evidence linking UAWC with armed groups, as confirmed by an independent investigation that was commissioned by the Dutch government. 

The withdrawal of funding furthermore threatens the crucial work of UAWC in supporting the rural economy and the agrarian sector in the Palestinian territories. The organisation’s mission is to support small farmers and community development in the Occupied Territories. This work is crucial to Palestinian society. Farming contributes to around 15% of employment in the Palestinian economy and ensures a level of food sovereignty for communities that face war and occupation. In the West Bank Palestinian small farmers regularly violent face attack by Israeli settlers and the Israeli military, who conspire to appropriate Palestinian land and resources. This reality emphasises the importance of UAWC’s work and illustrates the dire consequences of the decision by the Dutch government to withdraw its funding. We call on the governments to reverse this decision and fulfil its responsibilities under international law to organisations such as the UAWC and Palestinian civil society. We ask that the Dutch government listen to UAWC, whose great concern over the decision was voiced in a recent statement: “At this critical hour, we call on other donors to maintain and increase their support for UAWC and all Palestinian civil society organizations. Don’t abandon us.”
