The Issue

Double jeopardy is a serious issue that needs to be addressed at Harnett correctional facility. It is unfair for inmates to face multiple punishments for the same offense. This practice goes against the fundamental principles of justice and fairness.

According to a report by the National Institute of Justice, double jeopardy violates the Fifth Amendment of the United States Constitution, which protects citizens from being tried twice for the same crime. In addition, it can lead to excessive punishment and undermine public trust in the criminal justice system.

Harnett correctional facility has been accused of violating this principle by imposing multiple sanctions on inmates for one offense. This includes both disciplinary actions and administrative segregation, which can have severe consequences on an inmate's mental health, especially if the inmate has a mental disability. 

Furthermore, studies have shown that prolonged isolation can lead to psychological harm such as depression, anxiety, and even suicide attempts. Inmates who are subjected to double jeopardy may also face difficulties reintegrating into society after their release.

It is time for Harnett correctional facility to take action and put an end to this unjust practice. By implementing policies that prohibit double jeopardy and ensuring that all staff members are trained on these policies, we can ensure that inmates are treated fairly and justly.

We call upon Harnett correctional facility administration to take immediate action towards ending double jeopardy practices within their institution. Let us work together towards creating a more just criminal justice system where every individual's rights are protected regardless of their status in society or past mistakes they may have made.

I have read over 20 articles regarding inmates being sent to segregation for absolutely nothing just for having the"wrong"skin color.

My son is housed at Harnett correctional facility and this is his first time he's ever been to prison or had any legal issues so he's not perfect but who is? He's not familiar with rules and regulations within the prison walls but he received an infraction for disobeying an order, which can mean anything because their definition is so broad. He is also 27 with the mind of a 16 or 17 years old.  First he received a punishment of not having access to commissary. He was only allowed hygiene products from there for 30 days. On the final day of his withdraw of commissary he was sent to Central and was put in segregation for the SAME EXACT INFRACTION HE JUST GOT OFF PUNISHMENT FOR. I asked his worker if Harnett was a facility that caters to & are equipped to deal with people who have disabilities because I already knew that it was that type of facility. I then asked why they are not trained to deal with inmates that meet that criteria because I'm sure almost every person with a learning disability has disobeyed an order without even knowing they did something that the prison considers as wrong.

 After Devon Davis, whom has several disabilities, was put in segregation for 154 days it caught the attention of the News and the Observer. In 2016 The state Department of Public Safety announced that a number of changes were going to be made. One of those changes was that placing mentally ill inmates in restrictive housing is discouraged and WILL ONLY TAKE PLACE AS A LAST RESORT. 

My question still stands. Why has my son been punished twice for the same exact infraction? I already spoke to central so I now know for a fact that this is from the same infraction he already received 30 days of punishment for then being sent to segregation AS SOON AS THAT PUNISHMENT WAS OVER. 

There are so many articles and petitions against Harnett correctional and absolutely NOTHING HAS CHANGED. Something has to give. Please sign and share every petition you see against this facility so it can get into the right hands and hopefully staff will get proper training, if they are incapable of treating everyone fairly then they don't need to be there. We ALL have a past, correctional officers,judges, inmates, parents and the list goes on. If you're just there for the paycheck, please kick rocks and get the right people working here who want to work together and believe in treating others how they would like to be treated and I bet you'll see a change in inmates behavior because we're all human and a person can't take but so much of begin disrespected and treated inhumane.
