Justice for Sedrick Buchanan

The Issue

My name is Debbie Goodvine. I am the mother of Sedrick Buchanan, an inmate at Mississippi State Penitentiary MDOC # 206917. In June 2017, Sedrick  was convicted in Leflore County with 3 counts of aggravated assault. He was charged originally with 1 count of murder and 3 counts of attempted murder in which he was found not guilty of a trial but the prosecutor changed the 3 counts of attempted murder to aggravated assault. In the judge’s instructions to the jury, the judge told the jury as one of the elements that if Sedrick did not have a gun and shooting, he had to be found not guilty and if any 1 of the elements was not found, they had to find him not guilty. There was no evidence in the trial showing that Sedrick had a gun or any weapon or that he was even there, except for an unsworn hearsay statement of a co-defendant who was not present at trial to be cross-examined. The elements of aggravated assault are found in Mississippi Code Annotated section 97-3-7 (2) (a) (Rev.2014) : A person is guilty of aggravated assault if he or she (1) attempts to cause serious bodily injury to another or causes such injury purposely, knowingly, or recklessly, under circumstances manifesting extreme indifference to the value of human life (2) attempts to cause or purposely or knowingly causes bodily injury to another with a deadly weapon or other means likely to produce death or serious bodily harm or (3) causes any injury to a child who is in the process of  of boarding or exiting a school bus in the car the night of the shootings in Leflore County. The only evidence in this case comes from an unsworn statement of a co-defendant who was later killed. The prosecutor used a 40 caliber gun which had never been shot, did not belong to Sedrick, and was suppose to only be admitted into evidence as identification of the type of gun used in the shooting. Sedrick was a first time convicted felon and received the maximum penalty during an unfair trial and prosecutorial misconduct. Please help Sedrick get justice by signing this petition.
