The current law means that any person who makes an allegations against another no longer have to hand over their electronic devices to the police, however, those being accused of offences their devices are seized.
Bearing in mind it is the obligation of the police to carry out a full and fair investigation that should support both complainant and defendant, where there is potential evidence of a false allegation which in itself is a crime, this can no longer be accessed.
We have evidence of false allegations from phones obtained from complainants prior to the change in the law.
The case of R - V - Liam Allen as a prime example, Liam Allen would be serving a custodial sentence had it not been for the discovery of evidence to support his innocence discovered actually at trial when the prosecution were forced to disclose the mobile phone forensic image of the complainant.
