Respected Sir/ Madam
Kindly accept our respectful honour to you. With this memorandum we beg to state before you that we are the honourable PhD degree holders and also researchers from different central and state universities and universities of India. Inspite of acquiring the required efficiencies by doing PhD we have been deprived of getting employment in the colleges of Assam, due to current imposition of certain rules. So, in the points mentioned hereunder, we beg your consideration and instant interference.
As per University grants Commission Act, 1956 every Provincialised College in India functions in according with the principles of the University Grants Commission. As per mandate in website of the UGC for ascertaining the quality and sustaining the standard of higher education in the state and in the country as a whole, the University Grants Commission is responsible. In accordance with a clarification cited in the FAQs of UGC [F.17-6/2013(PS/MISC). Sept 2015] Higher Educational Institutions (HEI) are obliged to follow these rules of the UGC. Though the accepted rules of the UGC could be slightly modified, no drastic change is allowed. In such circumstances, employing the college teachers the directives prepared by the Director of Higher Education (DHE) of Assam, the following inconsistencies have been seen.
Currently the UGC has modified the college teachers’ appointment regulation. UGC Act, 1956 Minimum qualification for appointment of Assistant Professor Regulation has been modified in such as in 1983, 1985, 1991, 2010 and 2018. In such cases while appointing the college and university teachers the latest UGC regulation comes in force. In the Gazette of India (part III, Sec. 4, Page. 57), Regulation No- F.1-2/2017 (EC/PS) the July 2018, it has been cited that modifying the earlier UGC regulation of 30th June 2010, a new regulation has been published referring it as UGC Regulation 2018. As per this new regulation, based on the marking system on which a college teacher should be selected for appointment, that marking system has not been followed by the DHE of Assam. Though from 18th July 2018 onward UGC new regulations are in vogue, in the office memorandum (No- AHE.407/2017/44 Guidelines for Selection of Assistant Professor/ Librarian in Provincialised Colleges of Assam) served on 8th November 2018, only 4 clauses of the UGC Regulation 2010 (viz. qualification for Direct Recruitment of Assistant Professor: (Ref. clauses 3.0.0/4.0.0/4.4.0/4.4.1 of the UGC Regulations, 30th June 2010) have been obeyed. However, office memorandum (No. AHE.45/ 2019/2), DHE of Assam has followed the UGC’s latest regulations 18th July, 2018 in the cases of appointment of college Principals in Provincialised Colleges. But, in the case of selection of Assistant Professors, only a few clauses of the UGC Regulations of 30th June 2010 have been brought into consideration.
In the order served by the DHE, Assam for appointment of college teachers, the mark alloteed for the selective educational qualifications are as follows:
(i) 10% of the total marks secured in HSLC examination, maximum 10 marks.
(ii) 10% of total marks secured in HSSLC examination, maximum 13 marks.
(iii) 22% of total marks secured in Degree examinations, maximum 22 marks.
(iv) 25% of the total marks secured in post-graduation exam, maximum 25 marks.
(v) For PhD Degree 9 marks and for MPhil Degree 3 marks.
(vi) For published research paper or article in journal having ISSN index is 2 marks.
(vii) 4 marks for publication of research oriented articles in SCOPUS/Web Science/Web of Knowledge indexing related journals
(viii) For publication of Reference Book or chapter in textbook or writing of articles, 2 marks
(ix) For accepted research papers in International, National, State level seminars organized by educational institutions, 2 marks
(x) For teaching experience 5 marks. Besides that, in the case of oral interview for activity in the class room teaching 2 marks have been allotted and 3 marks have been fixed for highlighting the concerned subject of the interviewee. (No. AHE, 407/2017/44, dated Dispur, the 8th Nov. 2018)
On the other hand, as per UGC Regulation 2018 cited in the Gazette of India the selection procedures of Asst. Professor for colleges are as followed:
(i) At Degree level 21 marks for more than 80% marks secured, 19 marks for marks secured 60%-80%, 16 marks for 55-60% marks secured and 10 marks for 45%-55% marks secured.
(ii) For post-graduate level, 25 marks for more than 80% marks secured, 23 marks for marks secured 60%-80%, 20 marks for 55%-60% marks secured.
(iii) In the case of MPhil, 07 marks for more than 60% marks secured and 05 marks for 50-60% marks secured.
(iv) For PhD degree 25 marks
(v) For NET passed with JRF 10 marks and only for NET 08 and for SLET 05 marks.
(vi) For publication of Research paper or presentation 06 marks
(vii) For teaching experience 10 marks has been fixed. However, these rules have been nullified in the cases of high schools and Higher Secondary level.
(viii) For International and National award 3 Marks

Sir/Madam,
We want your instant interference for modifying the irrelevancy between the Regulations implemented by the DHE of Assam, and that of the UGC Regulation.
Our Demands are as follows:
1. Modifying the order promulgated in the office memorandum No. AHE, 407/2017/44, 8th Nov. 2018of the DHE of Assam, the UGC Regulation, 2018 (Regulation No- F1-2/2017/EC/PS) of 18th July 2018, published in the Gazette of India (Part-III, Sec. 4) should be brought into force.
For,
(a) During last for 10 to 15 years, the education policy of Assam in the cases of Higher Education and the evaluation of the marking system have been undergoing changes. As a result, only for differences in distribution of marks in the evaluation of academic performances, batches of candidates have been deprived of being efficient for teaching job in the University and\or colleges. So, the Regulation as designed by the UGC in order to bring uniformity in the teacher appointment in universities and colleges [Vide- The Gazette of India (part- III, Sec 4), table – 3(B); Sl. No. – 1,2; page 108] should immediately be implemented by the Director of Higher Education, Assam.
(b) Changing the system of distribution of marks adopted by the DHE of Assam in evaluating academic performances of a candidate for appointment in university/ college [Distribution of marks, i) Academic Records (70 marks) p. 3], the Regulation of the UGC [as given in Gazette of India, Part-III, Sec. 4, table 3 (B); Sl.no.- 1,2; page 108] should immediately be implemented.
2. In the case of selecting candidate having PhD, the distribution of marks for that should be 25 as fixed by the UGC.
Emphasising the research activity the MHRD extends fellowship of INR 31,000-35,000 per month for PhD research work under the schemes of the UGC. Thus, MHRD spends almost INR 20 lakhs for the research work of a researcher. A research scholar too spends a valuable time of his/her life from 3 years to 7 years. If such a person is deprived of being selected for appointment in the universities/ colleges, then it would indicate the wastage of fund of the treasury (public money) and the human resources of the country as well.
Moreover, as per the latest UGC Regulation, from 2021 onward, a college teacher not having PhD degree, shall not be promoted at all. From this point of view also the concerned appointee together with the college would confront a lot of problems.
From that viewpoint, while selecting a candidate for appointment in colleges, it is urgent to give emphasis on markings of PhD.
3. In teaching experience too, modifying the existing Regulation the distribution of marks as prescribed by the UGC, 10 marks (2 marks for each year, 10 marks for 5 years) should be given.
A candidate, after spending 5 years of his/her valued life for earning his/her teaching experience, it is unfortunately injustice to offer only 3 marks in evaluating the academic activity of a candidate under the Regulation of the DHE, Assam.
So, in the UGC’s Regulation emphasis ben laid upon teaching experience, so that experienced and expert persons are appointed in teaching.
4. UGC has mentioned the marking distribution for NET-JRF- 10 marks, for NET-8 marks, and for SLET-5 marks in selecting a candidate for appointment as teacher in the universities/colleges. Gazette of India, part-III, Sec.4; Table- 3(B), Sl.no. 5, Page-108). According that referred marking arrangement Net with JRF/NET/SLET should be done.
5. In the cases of the Higher Education priority of importance should be laid on oral interview. It has been noted in the UGC Regulation 2018 that while appointing college/university teachers, selection shall be based only on the performances in the interview. [India Gazette, Part –III, Sec.4, Page 108].
6. For the appointment of Assistant Professor in colleges no age bar is fixed by UGC. In the OM of DHE, Assam it fixed as 38 years for open category. It may lead to unemployment for the candidates who have been engaged in research.
7. In the cases of recent advertisement for appointment of Assistant Professor in colleges in Assam, the UGC’s Regulation, 2018 should be brought into force.
