Department of Transportations First time failed drug test for CDL permit holders

The Issue

Commercial drivers license permit holders who fail the DOT preemployment drug test. 

When a person obtains a CDLP(commercial drivers license permit), they need hours of on the road experience before a license is earned.

To receive training, they are to either go to a school, or get offered paid training through a company, or upfront cost training through a company.

The first drug test they are given is the DOT official drug test. When failed, the results are posted on clearinghouse.gov and shows a violation on their record until they complete the RETURN TO DUTY PROCESS. This process is to get a Substance abuse specialist to evaluate them, and prescribe a treatment, be it educational classes. Once completed they need to have a past employer/present employer/potential employer or a school help with the final steps of the process by signing off on the follow-up drug tests required. No one will accept someone into their company without completing the process first but the process can not be completed without the assistance from these entities. This petition is to give these first time offenders a second chance at the drug test given when only a permit is held. A career is ended before they are given a chance to show they are trying to change their lives for the better, but as it stands now, it's impossible for these permit holders to do anything with a failed test.

These people obtained these permits in order to better themselves and their families financially. 1 failed test before even getting in a truck, is career ending and near impossible to complete the steps needed to get their privileges reinstated. This would give CDLP holders the second chance needed without going through the Return to duty process. The importance of the first drug test is not fully stressed when obtaining the permit, if CDLP holders fail the first test and are shown what the consequences are of a second fail, many people would make an effort to never fail again.

This second chance is only allowed for permit holders who are receiving a pre employment drug test. The second chance is not for CDL license holders looking for employment at a second company. 

A failed test at one company does not mean they have to hire you if a second test is passed. 

It would be noted that you failed your first test but would be cleared if a second test is passed.

If a test is failed twice, you're cdl privilege may never be obtained.
