The Issue
Judge Mark McGinnis has recently made a ruling in clear defiance of the 13th amendment. When 7 nurses of Thedacare found better opportunities at Ascension healthcare company, their employer filed a frivolous lawsuit to unlawfully and unethically block their change of jobs. This is nothing short of act of forced labor. When judge McGinnis was presented with this suit, he had a civil duty as a court official to uphold the constitution. Not only did he fail to do one his most basic duties; even worse, his ruling sets a precedent that healthcare workers are not free to choose their employment. Such a situation can only be described as paid slavery. Thedacare was given every opportunity to retain these employees before their final acceptance of the offers from Ascension. Thedacare management was asked multiple times to counter or even match the offers presented by Ascension; they refused every time. Judge McGinnis has blatantly and willfully infringed on their freedoms of choice and self-determination wroth his dangerous ruling. For the safety and freedom of healthcare workers across America, it is imperative that the injunction he granted, barring the nurses from starting their new jobs for 90 days, be immediately overturned. No one should have to fear being sued or imprisoned because they found a better job.
