Revoke Zoning Permit for Harmful Denver Development
The Issue
Developer Barry Hirschfeld and his partners Pando Holdings Inc, have pushed a highly controversial Humboldt Street project through Denver City Council without consultation with the local neighborhood. Even now Hirschfeld and Pando refuse to meet with or discuss the development plans with neighbors that are concerned about its close proximity to aged care patients, the building's height, its visual impact in an historic neighborhood, and its lack of parking and bike racks. Local businesses and residents will be forced to subsidize parking for the development so the developers can maximize their return on investment. With 108 units, a restaurant, and zero parking spaces in a neighborhood already experiencing a parking crisis, the development should never have been approved.
So, why was it?
Mr. Hirschfeld and Pando Holdings took advantage of a zoning code that exempts buildings on small lots (6,250 square feet or less) from providing parking spaces. They bought two adjoining small lots on 16th and Humboldt Streets, which together total 12,500 square foot. They then submitted the development plan as two separate developments so they could take advantage of the exemption. The exemption was never intended for such a development.
This building permit must be revoked. Only by taking such firm action can we set a precedent in deterring developers from abusing planning laws in the future and disrespecting the surrounding community.
