Demanding Legal Responsibility for Road Maintenance: Reforming SA Liability Act

Demanding Legal Responsibility for Road Maintenance: Reforming SA Liability Act
The Issue
Have you ever driven on a poorly maintained road? Have you ever had to swerve or brake suddenly to avoid a pothole? Or worse, have you ever been in an accident caused by the state of the road? These are just some of the many ways that people are concretely affected by the problem of road maintenance. Poorly maintained roads not only damage our vehicles but also pose a serious risk to our safety. It's time to demand change and hold the government accountable for their lack of accountability.
How can our cars be roadworthy when our roads aren't carworthy?
What is at stake? The answer is simple: lives. If things stay the same, people will continue to be injured or even killed due to the state of our roads. The government's negligence in maintaining our roads not only puts our safety at risk but also affects our economy, as damaged vehicles and increased traffic congestion lead to higher costs for everyone. On the other hand, if we demand change and hold the government accountable, we can ensure that our roads are safe and well-maintained for all.
Why is now the time to act? We cannot wait any longer. The longer we wait, the more lives will be at risk, and the more damage will be done to our vehicles and our economy. It's time for immediate action, and the best way to do this is to make our voices heard. By signing this petition, we are showing the government that we will not stand for their negligence any longer. It's time to demand legal responsibility for road maintenance and ensure safe roads for all. So let's come together and make a difference - sign the petition today.
What needs to change :
"The Civil Liability Act 1936 (SA) states that a 'road authority' cannot be held negligent for a failure to maintain, repair or renew a road; or to take other action to avoid or reduce the risk of harm that results from a failure to maintain, repair or renew a road [s 42]"
"Section 105 of the Civil Liability Act 1936 (SA) provides that a road authority is not liable for any injury, loss or damage arising from its failure to repair, renew or maintain a road..."
This petition is requesting changes to the outdated Civil Liability Act in South Australia. We believe that the government should take accountability for their actions, or lack thereof, and be held responsible for injuries or deaths caused by their failure to maintain, repair, and renew roads. The Act needs to be amended to allow the prosecution of the state in such cases. By enshrining this legal responsibility in the law, we hope to put pressure on future governments to take accountability and be more proactive in preventing such accidents from occurring due to negligence.
