The Issue

I experienced firsthand the distressing and unacceptable situation that many victims of domestic violence face due to administrative failings in court systems. During the proceedings for my non-molestation order, I found myself in a chilling predicament—left alone in an online virtual waiting room with my abuser. This person was the very reason I sought legal protection in the first place. Then forced to undergo an online hearing in plain sight of this person, despite having specifically requested safeguarding measures to be implemented.

Such lapses are not just administrative oversights; they are glaring deficiencies that undermine the safety and wellbeing of victims. Unfortunately, this scenario is not unique to my case. Countless victims of domestic violence are forced to endure similar traumatic encounters, facing their abusers due to a lack of appropriate mechanisms to ensure their protection during court procedures.

The current system needs urgent reform. We must implement proper measures to prevent victims from having to face their abusers in any court context, whether it be in virtual settings or physical court rooms. Legal systems should incorporate separate virtual waiting rooms, enhanced security and privacy measures, and trained personnel who are alert to the needs of vulnerable individuals. Additionally, courts must provide clearer communication and guidelines to prevent administrative mistakes that could jeopardize a victim's safety.

An impactful reform could transform the way justice is served to victims of domestic violence, ensuring they receive the protection and respect they deserve. We need to call upon government authorities, judicial systems, and policymakers to prioritize the implementation of these protective measures as a matter of urgency.
