The Issue

We, the undersigned citizens and concerned observers, demand full disclosure and clarification from the United States District Court for the District of South Dakota and Prosecutor Ben Patterson in criminal case USA v. Maude et al, Case No. 5:24-cr-50081.

In this case — and many others across the country — the Plaintiff is listed in the caption as “THE UNITED STATES OF AMERICA”, a stylized all-capital entity. However, within the body of the filings, the party bringing allegations is repeatedly referred to as “The United States.” This inconsistency raises serious constitutional and legal questions.

Worse still, a legal entity titled “THE UNITED STATES OF AMERICA” is actively registered as a foreign corporation in London, England under UK Company Number OE015146, with a Washington, D.C. address.

Why This Matters:

If the Plaintiff in this case is truly the constitutional Republic created in 1787, then the court and the prosecutor must say so — and prove it. If the name “THE UNITED STATES OF AMERICA” is being used by a corporate fiction, this could constitute fraud on the court, deprivation of rights under color of law, and misrepresentation of a real party in interest.

Even more importantly, if the Plaintiff is the actual government, then the Sixth Amendment to the Constitution guarantees that the accused — in this case, the Maude family — has the right to face their accuser directly.

The government cannot merely send a representative — the prosecutor — to stand in place of the accuser.
The accuser must be identified and appear, or the prosecution lacks a lawful foundation.

Furthermore, Prosecutor Ben Patterson must prove that he is acting as a lawful officer of the government, not merely as a contractor or agent for an undisclosed corporate entity.

What We Demand:

A written certification from the Court and Prosecutor that the Plaintiff “THE UNITED STATES OF AMERICA” is not the British-registered corporate entity (Company OE015146).
A clear explanation of why “The United States” is used in the body of the filings if “THE UNITED STATES OF AMERICA” is the actual party bringing charges.
The identity of the actual accuser in this case — as constitutionally required — and proof of lawful delegation of authority from the real Plaintiff to the prosecutor.
Public access to the Oath of Office and commission of Prosecutor Ben Patterson, establishing his authority to act on behalf of the constitutional government.

This petition is not political. It is a demand for constitutional accountability and transparency in prosecution. The people — and the accused — have a right to know who is acting in the name of the government, and whether those actions are lawful.

We urge the court, the prosecutor, and all officers of the court to uphold their oaths and answer these questions in the interest of justice.

If the Court and Prosecutor Ben Patterson claim that the Plaintiff — styled as “THE UNITED STATES OF AMERICA” — is not the British-registered corporation (Company No. OE015146), then they have a constitutional obligation to prove it.

More importantly, if that Plaintiff is alleged to be the actual government of the United States, the Sixth Amendment guarantees the Maude family the right to confront their accuser directly. A prosecutor is not a substitute for an accuser. The government, if it claims injury, must appear and be proven to exist as a party — not merely represented by someone acting under color of title.

The existence of a foreign-registered corporation using this name only heightens the need for clarity and accountability. The people of the United States, and the Maude family specifically, are entitled to know:

·       Who is the real Plaintiff?

·       Is there a true, injured party?

·       What authority does the prosecutor have to speak for them?

If the Court allows prosecutions to proceed under vague or misrepresented party identities, the integrity of the legal system is compromised, and the public trust in the courts erodes.

We, the undersigned, demand that the Plaintiff be identified, the injury be proven, and the prosecutor’s authority verified — as required by the Constitution of the United States.
