Exigeons que le Canada fasse respecter le droit international humanitaire face aux violations israéliennes

Constat

Le Canada affirme respecter les décisions et mesures conservatoires de la Cour internationale de Justice (CIJ) [1]. Pourtant, depuis le 2 mars 2025, Israël empêche l’entrée de l’aide humanitaire à Gaza [2], prive la population d’électricité nécessaire aux usines de filtration d’eau et aux hôpitaux [3] [4], et bloque l’accès aux travailleurs humanitaires, médecins et journalistes étrangers [5] [6]. Ces actes violent le droit international humanitaire (DIH) [7] ainsi que les ordonnances de la CIJ des 28 mars et mai 2024, qui exigent «sans restriction et à grande échelle» la fourniture de services de base et d’aide humanitaire, et le maintien ouvert des points de passage, notamment Rafah [8] [9].

Depuis le cessez-le-feu du 19 janvier 2025, Israël méprise le DIH [10] [11]: il a refusé de négocier au 16e jour de la première phase comme l'exigeait l'entente [12] [13] [14], il ne s’est pas retiré du corridor de Philadelphie [15] [16], a retardé sans préavis un échange d’otages et de prisonniers palestiniens, et a tué plus de 150 personnes – soit 3 par jour en moyenne [17] [18]. À Beit Hanoun (13 mars), deux femmes et deux enfants ont péri [19]; à Beit Lahia (15 mars), 9 personnes, dont 4 journalistes et 5 humanitaires, ont été tuées [20]. Israël tente de justifier ces assassinats ciblés par des accusations infondées [21], tout en visant systématiquement les journalistes et en poursuivant les tirs à Rafah (15 mars) [22]. Même les familles d’otages israéliens ont dénoncé ces violations [23]. Le 18 mars, la guerre a repris à un rythme effréné, tuant plus de 400 personnes en quelques heures [24].

En Cisjordanie, les colons attaquent en toute impunité [25] – volant, par exemple, 800 moutons le 9 mars à Ras Ain Al-Auja [26] – tandis que l’IDF provoque 45 000 déplacements forcés [27] et 900 morts depuis octobre 2023 selon OCHA [28]. 

Preuves de violations systématiques du DIH 

Ces actes s’accompagnent de graves entorses au droit international humanitaire [29] [30] [31]:

• Pour chaque Palestinien libéré, 16 sont détenus, souvent des enfants [32]
• 61 Palestiniens sont morts dans les prisons israéliennes depuis octobre 2023 [33] [34], avec des cas documentés de torture et violences sexuelles [35] [36] [37] dans des centres comme Sde Teiman [38] [39] [40] [41].

Des responsables israéliens tiennent des propos contraires au DIH et incompatibles avec la Convention sur le génocide [42]: 

• «Bombardez dès aujourd’hui les stocks de nourriture à Gaza !» – Nissim Vaturi (2 mars 2025) [43] 
• «Rafah, Deir al-Balah, Nuseirat ? Extermination totale !» – Bezalel Smotrich (30 avril 2024) [44]
• «Séparez les femmes et enfants, tuez les adultes à Gaza» – Nissim Vaturi (23 février 2025) [45]
• «Pour anéantir, pour briser violemment, pour éradiquer complètement, pour oblitérer, pour réduire en miettes, pour pulvériser, pour incinérer, pour agir avec une cruauté sauvage, pour infliger un châtiment sévère, pour dévaster totalement, pour écraser sans pitié. Pour tout exterminer !» – Itamar Ben Gvir (19 février 2025) [46]

Ces déclarations et pratiques violent les principes du DIH, qui protège les civils et interdit les punitions collectives [47] [48], et soulèvent des questions graves au regard de la Convention pour la prévention et la répression du crime de génocide. Les Canadiens ont le droit d’attendre de leur gouvernement une indignation face à ce mépris du DIH. 

Nos demandes
En signant cette pétition, je demande au Canada 

• De condamner fermement les violations du droit international humanitaire par Israël et d’utiliser tous les moyens, y compris l’expulsion des diplomates israéliens, pour exiger le respect du DIH et des obligations de la CIJ. 
• De réévaluer l’accord de libre-échange avec Israël, censé être «féministe» [49], alors que les femmes palestiniennes sont chassées, torturées et violées [50]. 
• De sanctionner des responsables comme Itamar Ben Gvir et Bezalel Smotrich pour leurs appels répétés à des actes contraires au DIH. 
• De reconnaître officiellement l’État palestinien

Demand that Canada Enforce International Humanitarian Law Against Israeli Violations

Statement

Canada claims to respect the decisions and provisional measures of the International Court of Justice (ICJ) [1]. Yet, since March 2, 2025, Israel has prevented humanitarian aid from entering Gaza [2], deprived the population of electricity needed for water filtration plants and hospitals [3] [4], and blocked access to humanitarian workers, doctors, and foreign journalists [5] [6]. These actions violate international humanitarian law (IHL) [7] as well as the ICJ’s orders of March 28 and May 2024, which mandate the "unrestricted and large-scale" provision of basic services and humanitarian aid, and the keeping open of border crossings, notably Rafah [8] [9].

Since the ceasefire of January 19, 2025, Israel has disregarded IHL [10] [11]: it refused to negotiate by the 16th day of the first phase as required by the agreement [12] [13] [14], it has not withdrawn from the Philadelphi Corridor [15] [16], delayed a hostage and Palestinian prisoner exchange without notice, and killed over 150 people – an average of 3 per day [17] [18]. In Beit Hanoun (March 13), two women and two children were killed [19]; in Beit Lahia (March 15), 9 people, including 4 journalists and 5 humanitarian workers, lost their lives [20]. Israel attempts to justify these targeted killings with baseless claims [21], while systematically targeting journalists and continuing shelling in Rafah (March 15) [22]. Even Israeli hostage families have denounced these violations [23]. On March 18, the war resumed at a frantic pace, killing over 400 people in a few hours [24]. 

In the West Bank, settlers attack with impunity [25] – stealing, for instance, 800 sheep on March 9 in Ras Ain Al-Auja [26] – while the IDF has caused 45,000 forced displacements [27] and 900 deaths since October 2023, according to OCHA [28]. 

Evidence of Systematic IHL Violations

These acts are accompanied by serious breaches of international humanitarian law [29] [30] [31]: 

• For every Palestinian released, 16 are detained, often children [32]
• 61 Palestinians have died in Israeli prisons since October 2023 [33] [34], with documented cases of torture and sexual violence [35] [36] [37] in facilities like Sde Teiman [38] [39] [40] [41].

Israeli officials make statements contrary to IHL and inconsistent with the Genocide Convention [42]:

• «Bomb the food stocks in Gaza today !» – Nissim Vaturi, March 2, 2025 [43]
• «Rafah, Deir al-Balah, Nuseirat? Total extermination !» – Bezalel Smotrich (April 30, 2024) [44]
• «Separate the women and children, kill the adults in Gaza» – Nissim Vaturi (February 23, 2025) [45]
• «To annihilate, to violently break, to completely eradicate, to obliterate, to reduce to crumbs, to pulverize, to incinerate, to act with savage cruelty, to inflict severe punishment, to totally devastate, to crush mercilessly. To raze everything!» – Itamar Ben Gvir (February 19, 2025) [46]

These statements and practices violate IHL principles protecting civilians and prohibiting collective punishment [47] [48], while raising serious questions under the Convention on the Prevention and Punishment of the Crime of Genocide. Canadians have the right to expect their government to express outrage at this contempt for IHL.

Our Demands
By signing this petition, I demand that Canada: 

• Strongly condemn Israel’s violations of international humanitarian law and use all available means, including the expulsion of Israeli diplomats, to enforce compliance with IHL and ICJ obligations.
• Reassess the free trade agreement with Israel, touted as "feminist" [49], while Palestinian women are displaced, tortured, and raped [50].
• Sanction officials like Itamar Ben Gvir and Bezalel Smotrich for their repeated calls for acts contrary to IHL. 
• Officially recognize the State of Palestine.
