The Issue

My wife and I have been navigating the complexities of the U.S. legal immigration process, dedicated to living our lives together in one country. However, after four challenging years, our path has been obstructed by a system that lacks transparency and accountability. Eighteen months ago, we were plunged into a state of uncertainty—referred to as "Administrative Processing." Like many others, we find ourselves stranded in different countries, waiting for a decision that may never come.

Administrative Processing, a term often weaponized by embassies and the State Department, stalls thousands of families like ours in endless queues. Currently, those affected are offered no reasons for why their applications are delayed, nor are they given any clear timelines for resolution. This lack of transparency not only affects the individuals but disperses families across continents, leading to emotional distress and financial turmoil.

According to the U.S. State Department, Administrative Processing is an integral part of visa reviews, yet there’s little to no transparency about its necessity or the reasons behind its unpredictability. This leaves many in legal limbo—a purgatory where hope becomes indefinitely postponed. With 40% of immigration applicants experiencing similar issues, as reported by the National Foundation for American Policy, this is not an isolated incident but a systemic problem.

We propose that the State Department introduce concrete guidelines to cap Administrative Processing to a fair and predictable period of no more than eight months. Immigration applicants deserve clarity and transparent communication regarding their legal status. We should not have to resort to costly and lengthy court proceedings to obtain basic answers from our government.
