Demand Protection and Advocacy for Sole Traders Working with NDIS Participants
The issue
I am a sole trader who had the absolute privilege of assisting an NDIS participant for four dedicated years. I loved my work and the opportunity to improve the quality of life for my client. But the journey was marred by the unpleasant experiences I had with my client's husband, who devalued my contributions with his, in my opinion, adverse behaviour. When I called him out and stood up to him, my workplace became very uncomfortable.
I was subjected to weeks of relentless bullying, accusations, and behaviour that could only be seen as trying to force me to resign. My job was even advertised before I was let go. It was horrendous. For the first time in my 20-plus year career, I went to see my doctor for the stress it was causing me. I reported his behaviour to the Participants Support Coordinator but no effective support was available. I also went to the police. Yes! It was that bad. The other staff were all very aware of his behaviour but for fear of losing their jobs, remained and will remain, tight lipped and I bare no ill feelings towards them. Job security is everything and we were/are all mothers with families to support. You don't say anything.... you still have an income.
I will be silenced no more!
Effective immediately, my services were ceased, so, without any preparation, my sole income, very much needed by my family, gone! I worked 50+ hours a fortnight there, and I was on future rosters....
No chance to say goodbye to a person I absolutely adore and had a very strong connection with.
She had no Choice and Control!
In most other work settings, I would have had a very strong case for unfair dismissal, and with all the evidence I have, I would have won.
Unfortunately, my story is more than likely, not unique. There would be many, like me, who bear tremendous hardship, hostile and toxic work environments when dealing with NDIS participants' partners or relatives and I'm sure, the Participant themself.
This needs to change. It's imperative we call on Bill Shorten to introduce measures that not only protect sole traders like us but also provide a platform for advocacy against such mistreatment. No one should ever feel silenced and no one should ever feel vulnerable at work! Workplaces, irrespective of where they are, MUST be havens of respect and dignity.
Around 19,000 sole traders are registered for NDIS, offering their services and enriching the lives of NDIS participants. They deserve to be treated with respect and dignity at THEIR PLACE OF WORK. It's time to step up and protect the rights and working conditions of these committed and self-motivated workers.
