CONSTITUTION OF ZIMBABWE DOWNLOAD
REPURCUSSIONS
4.5 mil Zimbabweans are refugees worldwide with 2mil in SADC states over gross violations to -International Covenant on Civil and Political Rights, Convention on the Elimination of All Forms of Racial Discrimination, International Covenant on Economic, Social and Cultural Rights, Universal Declaration of Human Rights.
Main Opposition was infiltrated to Recall Legislators, Councilors and split the party in a matrix to frustrate and create vacuum for talks and potential GNU with ZanuPf currently on internal splits to ‘impeach’ their leader in theatrical succession.
Electoral Commission is conducting numerous By- Elections, which is now fortnightly business in autocracy by ZanuPf to Maintain 2/3 Majority from 2023 Illegitimate elections. ZanuPf Regime reigns with terror from Land Invasions, Company Seizures, Money Laundering by Central Bank, Electoral Fraud, Operation Murambatsvina, Coup d’état 2017 Operation Restore Legacy, 2018 Military Shootings are accumulative to 2008 human butchering’s, lest we forget 20000 plus victims from 1987 Gukurahundi with additional mass graves uncovered and daily assassinations, incarcerations, abductions, tortures and arson. 95% of Population is in a 2.6 % fatality rate of 12000 plus case with over 300 deaths -undergoing Electricity and Water Shedding 24-96hrs in a Cholera Outbreak -not limited to Hospitals, Prisons, Morgues, Schools, Courts, Industry, etc.
Gross Human Rights Violations in Zimbabwe undermine the fundamental principles of democracy with Law enforcement agencies adopting an unsettling approach to crackdown on opposition with denial on rights of freedom to association, peaceful and expression. Article 20 of the African Union Charter on Human and People’s Rights states that colonized or oppressed people shall have the right to free themselves from the bonds of domination by resorting to any means recognized by international law.
ELECTORAL REFORMS
Reference is given to formal submission made on Electoral Reforms and decision to Boycott the 23 August 2023 Harmonized. Arms of State are captured by ZanuPf which has passed draconian laws against democracy to revamp 2013 Constitution by Referendum. Legislation has without shame, received hefty packages to overnight constitution amendments and Bills without inclusivity of Citizens - from Patriotic Act, Cyber Act, Electoral Act, Law and Order.
Key Reforms to 2023 Elections and 2024 Fresh Elections are Disbandment of Polls from Presidential, Parliament, Council with Abolishment to Senate without compromise to principles of transparency, accessibility and legal
certainty. Rights of Assembly, Association, Expression are infringed to orchestration of gross human rights violations.
VOTER REGISTRATION
ZanuPf Regime channels resources to electoral fraud with unconstitutional deployment of state personnel to circumvent the process and rules guiding to democratic elections on winner grabs all harmonized election. Biometric Voter registration introduced 2017 was anti-rigging measure to curb cases of deceased voters, ballot stuffing, multiple voting, alien and unregistered voters from hazardous manual voters register of 1980. Data Entry captured by ZEC was shared to ZanuPf to target citizens against their rights to privacy and political affiliation. Protocol to registration in rural areas was based to ZanuPf affiliation with Forever Associates of Zimbabwe – Arm of the state mobilizing citizens with ZanuPf Identity Cards on a polling station-based system while opposition members were turned away on fictious insufficient documents not satisfactory to captured commission.
CIVIC AND VOTER EDUCATION
Electorate was not conscientized to understand their rights, roles and obligations in the electoral process with reverse arms on 23 – 24 August 2023 to militarized 24hr delayed voting, lack and shortages of voting material, disfigured ballot papers not matching candidates or party symbols, missing names on voters roll and systematic shift of such to
unknown boundaries. Zimbabwe Electoral Commission conduct to supervision, accreditation to voter education service providers was neither transparent nor in accordance to Section 239 of the Constitution.
NOMINATION COURT
ZanuPf Regime merged with Political Actors Dialogue (POLAD), a group of parties from 2018 Disputed Elections in Elimination Tactic to Introduce Exorbitant Nomination Fees prior to 2023 Elections.
There was no fair representation to women, youth and persons with disabilities but rather monopoly to retired citizens incorporated mostly from ZanuPf and Ceremonial Senate introduced to derail direct impeachments to Head of State. Opposition Candidates were disqualified on purpose by the Electoral Commission to aide ZanuPf maintain 2/3 Majority in Parliament with By -Elections as aftermath. Captured judiciary assured the court processes will not overturn judgement to such candidates contesting from Presidential, Parliament and Council with nomination fees being none- refundable to none participants.
Final Delimitation and Voters Roll were not issued to with repercussions of bogus polling stations and voters roll, leading to vote rigging and ballot stuffing. Delimitation Exercise was initiated and conducted by Zanu pf
not ZEC to alignment of its support base with neutralization to opposition strongholds.
CAMPAIGN ENVIRONMENT AND VOTING PROCEDURE
ZanuPf used coercion, force and intimidation to capture polling stations in calculated move to manipulate the voting process with specific candidates assured victory out of reach of observers. Polling Agents drawn from opposition and independent candidates were in tragedy ousted from polling stations alongside Chief Election Agents being
abducted before, during and after elections to rectification of manipulated results from V11s and V23s Forms.
Rural Areas faced night parades and roll calls in sequence of voting which were used on 23-24 August 2023 with Electorate under intimidation to absenteeism with instructions on reporting to Joint Operations Command deployed personnel 100m from Polling stations nationwide, in addition to irregularities on forced Voter Assistance to aided literate voters alongside Pwds with no democratic right to choose their preferred candidates.
Opposition Activists died in action, while others incarcerated with state enforcing curfews during overnight voting of 23-24 August 2023 while Postal Voting was supervised by Joint Operations Command and conducted twice with initial stage as mock exercise on atmosphere within the system, in both instances without supervision from polling agents or observers.
Online Systems to Voter verification were not accessible on 23-24 August 2023 with electorate advised their names not in given provinces, constituencies and polling stations whilst ZanuPf Bused electorate with a fixed voter’s roll displayed outside of supposedly voters from unknown origins with under siege citizens being arrested for no apparent reason.
There was No Declaration to Quantity of Printed Ballot Papers inclusive of serials and security features in a rigging mechanism without a voters roll to stakeholders in time.
ELECTORAL COMMISSION
Constitution and Guidelines to Principles Governing of Democratic Elections including protocols on Gender by SADC, AU and UN not adhered. Zimbabwe Electoral Commission has mandatory obligation to managing, supervising, collation and announcement of election results in a transparent and non-partisan manner to which the current ZEC Board of Commissioners comprises immediate relatives of High Ranked ZanuPf Officials with same Board Chaired by the Defence Forces Commissioner.
Electoral Commission lacked Independence with Temporary Staff recruited being Presiding Officers from Joint Operations Command including trained teachers, nurses assumed to be civilians with court martial consequences to divulge such operations. Guidelines and Protocols to democratic Elections were not followed with direct breach of the constitution by ZEC in all instances.
ZanuPf fielded current serving ZEC Commissioners and Ex-Officio on 23-24 August 2023 Elections in several constituencies as their candidates from Local Authority, Parliament, Senate, etc. Plagiarism was done to 2018 harmonized elections results, with inflating of figures on minority contenders
OBSERVER MISSIONS

PRESS FREEDOMS
The Patriotic Act, officially known as the Maintenance of Peace and Order Act (MOPA), was signed into law in 2019, replacing the Public Order and Security Act (POSA). - Accreditation requirements: Journalists must obtain accreditation, which can be denied or revoked, limiting access to information.

- Organizations like the Media Institute of Southern Africa (MISA) and the Zimbabwe Union of Journalists (ZUJ) advocate for press freedom and support journalists.
ELECTIONS:
- Biased regulations: MOPA's provisions favor the ruling party, restricting opposition parties' ability to campaign freely. Opposition relies on foreign and social media to express their freedoms of speech.
- Suppression of dissent: Authorities use MOPA to disperse opposition rallies and arrest activists.
- Limited Observation: MOPA restricts election observation, making it difficult to ensure transparency and fairness.
HUMAN RIGHTS VIOLATIONS:
- Excessive force: Security forces use MOPA to justify excessive force against protesters and opposition supporters.
- Arbitrary Arrests: Authorities detain individuals without due process, often on trumped-up charges.
- Torture and ill-treatment: Detainees face torture, ill-treatment, and inhumane conditions.
- Restrictions on Assembly and Association: MOPA limits citizens' rights to peaceful assembly and association.

Arms of State are captured by ZanuPf which has passed draconian laws against democracy to revamp 2013 Constitution by Referendum.

Polling Agents drawn from opposition and independent candidates were in tragedy ousted from polling stations alongside Chief Election Agents being
abducted before, during and after elections to rectification of manipulated results from V11s and V23s Forms.

There was No Declaration to Quantity of Printed Ballot Papers inclusive of serials and security features in a rigging mechanism without a voters roll to stakeholders in time.
ELECTORAL COMMISSION

- Suppression of dissent: Authorities use MOPA to disperse opposition rallies and arrest activists.
