Demand Federal and State Action Against Fraud by SmartFBA, SmartWholesale CEO, COO,CFO
The Issue
Hundreds of small business owners — including U.S. veterans and disabled entrepreneurs — have been defrauded by a trio of individuals operating a web of automation scams under the names Smart FBA, SmartWholesale Oregon, and SmartWholesale Texas.
These companies, run by Scott Hunt, Cohen Branden Chorabik, and Phillip C Kramer, collected millions of dollars from sellers and claimed they would launch Amazon, Ebay, Poshmark, Mercari and Walmart stores on our behalf. We paid, They selected and sent our inventory to Oregon warehouses, and we were promised returns. What we got instead was:
Ghosted communication
No access to stores or sales reports
No returned inventory
And in many cases, evidence of our goods being sold or destroyed
Victims have contacted Amazon, submitted formal complaints to:
The FBI, The FTC, The SEC, The U.S. Department of Justice
New York Attorney General
Texas Attorney General
Oregon Attorney General
All none of them have pursued criminal action against the perpetrators of this fraud.
But we ask: how is large-scale inventory theft, cross-state business fraud, and mail fraud not criminal?
Warehouses in Oregon held thousands of units of seller inventory. When the operators walked away, they did so with no accounting, no restitution, and no prosecution.
We demand that:
The DOJ open a criminal investigation into interstate wire fraud and conversion.
The State Attorneys General of NY, TX, and OR reopen cases based on volume, deception, and cumulative harm.
That Amazon, Ebay, Poshmark, Mercari and Walmart provide transparency on whether seller inventory passed through their systems during this scheme.
