Demand Fair Treatment and System Accountability for Walmart Canada Spark Drivers

The Issue

We, the undersigned Spark Drivers in Ontario, are formally petitioning against the systematic and unjust harassment of independent contractors through repetitive "At Risk of Deactivation" alerts. These notices, often sent without specific evidence or clear explanation, constitute a hostile work environment that jeopardizes our ability to perform our duties and causes significant psychological distress.

 

​Mental Health and Workplace Safety:-

​The constant threat of immediate job loss based on vague algorithmic flags has created a hazardous working condition. The resulting anxiety and mental health strain are not only detrimental to our personal well-being but are hazardous to the safe delivery of goods on Ontario roads. A driver operating under extreme mental duress is a driver whose focus is compromised by corporate intimidation.

Evidence of Unjust Communication:-

​Drivers are receiving a barrage of conflicting and automated deactivation threats for alleged "location spoofing" or "use of bots" accusations that are frequently baseless.

 

We reference the following documented instances of these Deactivation Email alerts sent to almost all Spark Drivers community in Ontario on Monday 11th May 2026 and Tuesday 19th May 2026 as evidence of this systemic issue. These communications demonstrate a failure of the Spark Driver App to accurately distinguish between legitimate third-party app interference and actual Terms of Use violations.

 

​The Demand for Technical Parity:-

​If Walmart Canada believes that standard background applications are interfering with the Spark Driver App, it is the legal and technical responsibility of the company to upgrade its infrastructure. Platforms like Uber and DoorDash have successfully updated their systems to function alongside other apps without resorting to threatening their workforce. We demand that Spark invest in system upgrades rather than penalizing drivers for the app’s own technical limitations.

 

​Notice of Legal Intent:-

​Let this petition serve as a formal notice: If these unfounded threats and arbitrary deactivations continue, the driver community is prepared to pursue Class Action litigation within the Ontario Court system. We will seek damages for wrongful termination, mental anguish, and breach of contract.

 

​We demand an immediate end to automated deactivation threats and a transparent, human-led review process for all account flags.
