Under New York Vehicle and Traffic Law (VTL § 238(2)) and binding precedent from the NY Court of Appeals (Matter of Ryder Truck Rental and Matter of Wheels, Inc.), a misdescription of mandatory elements on a parking ticket—such as the vehicle's body type—renders the ticket jurisdictionally defective and requires mandatory dismissal. 

The statute makes no exception for vehicles registered outside of New York. Yet, NYC Administrative Law Judges and the Parking Violations Bureau routinely dismiss errors for in-state drivers while illegally holding out-of-state vehicles to lower standards. 

As courts nationwide and the U.S. Supreme Court have made clear, administrative agencies cannot rewrite clear statutes or invent unwritten exemptions. We are calling on the NYS Supreme Court and the City of New York to enforce the law equally: A fatal error on a parking ticket is a fatal error, regardless of what state is on the license plate.
