Demand Due Process for Parents Fighting Against CPS

The Issue

I need your support to seek justice in my child custody case. Due to malicious prosecutions by Child Protective Services [Redacted] and the San Bernardino County Juvenile Dependency Court, under Judge Steven Mapes, and a lack of due process as a result of ineffective counsel from Vincent W. Davis & Associates (Elizabeth Jacobo), my son was unjustly taken from my custody. This process has been marked by a blatant disregard for the truth and my civil rights.

My lawyer's failure to present key evidence allowed false allegations by my ex-husband to go unchallenged. Professionals involved in the case supported my son's recantation of the allegations and identified coaching by his father. Despite my son testifying in court and clearly being a victim of parental alienation, the court ignored these critical findings. Instead, they believed that as an LCSW, I had manipulated my son to recant the allegations. Despite evidence of coaching and planning of the allegations evidenced on Talking Parents by the father, my lawyer did not present this crucial information.

Additionally, the Fourth Appellate District, Division Two, of the California Court of Appeal misinterpreted key rules, such as rule 8.387(b)(2)(B), which should have extended the finality of the order summarily denying my habeas petition, the only avenue to appeal ineffective counsel. The Court of Appeal rejected my petition for rehearing, applying incorrect rules and failing to provide a thorough review of my case.

The California Supreme Court then denied my request for review, which was my last remedy for challenging the juvenile court's orders. Due to these procedural failings and the court's disregard for the truth, my son was unjustly removed from my custody and placed with his father. Consequently, I haven't seen my son since.

I am seeking the following remedies from the decision-makers involved:

Review and Reconsideration of My Case:
