CSUCI Public Records,
Thank you for your response regarding my prior Public Records Act (PRA) requests. Unfortunately, your assertion that the campus has responded “in accordance with the Public Records Act” under Government Code Section 7923.610 is demonstrably false and misrepresents both the facts of this case and your obligations under the California Public Records Act (CPRA).
Your repeated denial that I am a “mentioned party” in Incident Report 1810020088 is contradicted by CSUCI’s own records. Specifically:
1. Contradictory Evidence: In the document titled Incident 1810020088 Mansour Mentioned Party, my name is explicitly listed as a “Mentioned/Other party” on page 2 of the report. However, your September 23, 2024, correspondence falsely claims that “You are not a mentioned party in Incident Report 1810020088.” This blatant falsification is indefensible and raises serious concerns about CSUCI’s integrity in handling public records.
2. Pattern of False Statements: This is not an isolated incident. CSUCI has issued similar denials for other incident reports (e.g., 1906180021, 1906280019, 1907200040, 1908280042) despite my documented evidence proving otherwise. This pattern reflects a deliberate effort to mislead and obstruct access to records.
3. Violation of CPRA: Under the CPRA, Government Code Sections 7921.300 and 7921.500 mandate transparency and timely access to public records. By providing falsified responses, CSUCI is in direct violation of:
• Government Code Section 7921.500: Requires public agencies to make public records promptly available upon request. Your failure to provide records within the legally mandated timeframe (5.5 years instead of 10 days) constitutes a severe breach.
• Government Code Section 7921.300: Prohibits agencies from obstructing access to public records. Providing demonstrably false information to deny access is an egregious form of obstruction.
4. Accountability for Misrepresentation: Your reference to Government Code Section 7923.610, which governs redactions and exemptions, is irrelevant in this context. The issue is not redactions or exemptions—it is CSUCI’s deliberate issuance of false statements to deny the existence of records that clearly identify me as a mentioned party.
Given the substantial evidence of CSUCI’s noncompliance, I demand the following:
• Immediate Disclosure: Full and unredacted copies of all requested records associated with the incident numbers provided.
• Explanation for Misrepresentation: A detailed written explanation of why CSUCI issued false statements regarding my status as a mentioned party.
• Corrective Measures: A clear outline of the steps CSUCI will take to ensure future compliance with the CPRA.
Should CSUCI fail to comply with its legal obligations and address these violations promptly, I will have no choice but to pursue further legal and administrative actions to hold the university accountable. This matter is not subject to further obfuscation or delay.
