

Demand accountability and remedy from Cafcass
The Issue
I have spoken with multiple parents who describe remarkably similar experiences with Cafcass, the Children and Family Court Advisory and Support Service. Although every family's circumstances are different, recurring themes have emerged: concerns about recommendations that were inconsistent with Cafcass's own policies or guidance, significant financial and emotional costs, lengthy delays in rebuilding or strengthening parent-child relationships, and a lack of an effective remedy for acknowledged errors.
Cafcass is entrusted with safeguarding the welfare and interests of children in family court proceedings, yet too often we see instances where its recommendations have proven detrimental to the very families it aims to protect. When recommendations contradict their own guidelines and policy, families are left to navigate an already challenging situation without the support and assurance they deserve.
This issue has become deeply important to me and many others, as the impact on families can be profound and lasting. Distrust, emotional trauma, and extended legal battles often ensue, leaving children caught in the middle. It is crucial that we address these shortcomings in Cafcass's operations to ensure that they do not continue to cause harm to families and adequate remedy is provided to those already harmed by Cafcass incorrect recommendations.
The letter shown is just one example of where a incorrect recommendation was made and the response from Cafcass is 'sorry' and we will improve things for future users but sorry and improvement for future users does not cut it because that is not a sufficent remedy for the person affected by the incorrect recommendation.
Therefore, I am calling for greater transparency in how Cafcass operates, stronger quality assurance measures, and a fair process to review cases where incorrect recommendations may have influenced court decisions about children's relationships with their parents. We need a system in place that not only holds Cafcass accountable but also provides clear remedies for families adversely affected by their errors.
Cafcass must implement a transparent complaint review process that allows for errors to be tangibly addressed without undue delay and proper personal remedy to be provided. Such a process will help safeguard the integrity of decisions impacting the lives of children and ensure that previous mistakes can be effectively corrected, rebuilding trust within families.
