Demand a Retrial for alleged assault victim Sean Leech O’Brien

On behalf of my beloved and vulnerable brother, who is diagnosed with autism, this petition seeks justice. In 2019, an appalling incident occurred where he was involved in an alleged assault with a care worker. The incident left a deep scar on my brother and our family.

Despite the severity of the situation, the case was not thoroughly examined and resulted in a questionable trial outcome. The care worker in question managed to win her appeal, a can now work with vulnerable people again. This result was disheartening and concerning, as it exposes other vulnerable entities like my brother to potential harm.

It is a disturbing fact that there is a long-standing deficit in the legal system's ability to accommodate people with cognitive disabilities. According to the National Autistic Society, approximately 65% of autistic adults in England and Wales have not received enough support to meet their needs. Meanwhile, 70% of autistic adults said that with more support, they would feel less isolated. This lack of care and attention is reflected not only in daily life but is acutely felt in the judicial circuits as well.

Many of you follow Sean’s journey so you have an understanding of his mindset and you can see just how vulnerable he is. 

In March 2019 Sean rang his mam via video call from a residential facility in Dublin. He was frantic screaming down the phone saying he had locked himself in his room and had “allegedly been bitten by a female care worker’, He showed our Mam what looked like bite marks on his left shoulder! Luckily the residential facility was 10 minutes from our family home, his dad rushed to the facility where he found Sean very distressed with injuries to his shoulder. He removed Sean from the facility and brought him to our family home immediately. Videos and photos were taken on the night!

 The female care worker was found guilty in the Dublin’s District court a few years ago but appealed the decision and won her appeal on Friday last Dublin criminal court ( 28-06-24).

We are appalled by the outcome. The judicial system has failed us all. Our system is broken! 

Sean is an extremely vulnerable person and the judge could not take his word or statement/evidence into account because he has a mental disability “Autism” even though a forensic psychiatrist who assessed Sean at length. The forensic psychiatrist put in his report that Sean is unable to fabricate or hold up a story, what Sean reports are indeed factual events that happened to him.

Sean has not changed his statement over the past 5 years he will tell it exactly as he told it on the night it happened! Because he is unable and incapable of making any changes to actual events that (allegedly) happened to him.
