Defend Justice in Minneapolis: Stop the DOJ’s Attack on Racial Equity in Prosecution
The Issue
Hennepin County Attorney Mary Moriarty was elected on a promise to bring compassion, fairness, and accountability to a system too often driven by punishment over progress. Now, the U.S. Department of Justice has launched a politically charged investigation into her office: for daring to consider racial disparities when negotiating plea deals.
This isn’t about breaking the law. It’s about acknowledging reality. Our justice system has long produced unequal outcomes for Black and Brown communities. Ignoring those disparities only perpetuates the harm. Moriarty’s policy doesn’t create special treatment—it asks prosecutors to consider the whole person, including race and age, to make fairer, smarter decisions that help reduce cycles of incarceration and crime.
The timing and tone of this federal probe are alarming. It comes after a conservative backlash and the appointment of a new Civil Rights Division head with a history of opposing civil rights litigation. Meanwhile, the DOJ has put Minneapolis’s long-awaited police reform agreement on hold, calling into question its commitment to equity and justice.
We cannot allow partisan politics to undermine progress in the very city where George Floyd was killed. Prosecutors should be empowered, not punished, for trying to correct systemic injustice.
We call on the Department of Justice to immediately end its investigation into Hennepin County Attorney Mary Moriarty and support local efforts to build a more equitable legal system.
