
The State Attorney General’s Office has asked an appeals court to reconsider a ruling which would allow Travis Archer, who killed Ponce the dog, to own animals again, according to a press release. In a split decision released Dec. 18, the 5th District Court of Appeal in Daytona Beach struck down a ruling by Circuit Judge Sandra Upchurch prohibiting Archer from ever owning animals again.The Attorney General's Office, which handles appeals of such cases, filed a motion on Tuesday asking the 5th District Court of Appeal for a rehearing on the issue. The Appeals Court could agree to rehear the matter or deny the request. “Two weeks ago, the Appellate Court ruled that the trial court exceeded its jurisdiction by imposing the lifetime ban even though Archer and his attorney agreed to this condition,” according to the press release from Bryan Shorstein, the executive director for 7th Circuit State Attorney R.J. Larizza.But Judge Richard B. Orfinger and Judge John M. Harris, two of the three judges on the three-judge panel ruled that Archer and his defense attorney, Aaron Delgado, had agreed to a ban only if one could be crafted.
