The Issue

With all the growing concerns of the data centers expanding into North Dakota, we are trying to have our voice heard by the Morton County Commission.. We would like the regulation added that any data center can be no closer than 5 miles from a town in which there is a school or church. This allows for not only the community’s safety but also for the future expansion of that community.

The bylaws of the Morton County Planning & Zoning Commission allow the Planning & Zoning Commission to form a subcommittee for the purpose of investigation or deliberation concerning matters of importance to the Planning & Zoning Commission. At the April 28, 2026 Morton County Commission regular meeting, the Planning & Zoning Director inquired about the County Commission’s sentiment toward the Planning & Zoning Commission forming a subcommittee to perform additional, detailed work on specific use standards for data centers within Morton County. The consensus of the County Commission seemed to be that they would support the Planning & Zoning Commission in forming a subcommittee for that purpose. At the next Planning & Zoning Commission meeting, taking place on May 27, there will be an agenda item for the Planning & Zoning Commission to discuss the possibility of forming a subcommittee to perform further detailed work on data center specific use standards for Morton County. In the estimation of the Planning & Zoning Director, a productive composition for that subcommittee would be the following sets of expertise: 1. A County Commissioner/P&Z Portfolio Holder 2. P&Z Commissioner (could be more than one) 3. Community advocate who also understands planning principles (could be more than one) 4. An engineer with experience in acoustics and/or vibration analysis/modeling 5. Energy sector representative (someone from a major energy supplier like Basin Electric or Mor Gran Sou, who understands energy supply operations and the effects of large load transfer on the grid) 6.
