The Issue

We, the parents, guardians, and community members of District 49 students, are calling on the Board of Education to uphold policies that protect student privacy, safety, and well‑being in a manner that is lawful, trauma‑informed, and developmentally appropriate.

Our district serves a diverse community of children with a wide range of needs. Any policy changes must reflect that reality and avoid creating unnecessary risk, confusion, or harm.

We respectfully request that the Board:

  • Maintain and strengthen student‑privacy protections that prevent unnecessary disclosure of sensitive information.
  • Ensure compliance with Colorado anti‑discrimination laws and federal civil rights requirements.
  • Preserve trauma‑informed practices that support students who may be vulnerable, marginalized, or at risk.
  • Provide safe, and accessible facility options for any student who needs additional privacy.
  • Engage parents transparently when considering policy changes that affect student safety or well‑being.
  • Avoid abrupt reversals or repeals that could destabilize school environments or increase risk for students.

Why this matters:
Parents want policies that protect every child, not policies shaped by fear, misinformation, or political pressure. We want thoughtful, lawful, evidence‑based decisions that prioritize student well‑being and reflect the needs of our entire community.

Our request:
We urge the Board to retain and refine student‑privacy and safety policies rather than repeal them, ensuring they remain aligned with Colorado law, best practices in child development, and trauma‑informed care.

Clarification of what you are signing:

This petition is championing for ALL students’ rights, not advocating against any group. Every child deserves privacy in bathrooms and locker rooms, and every child deserves to feel safe. These are intimate environments, and safeguarding in these spaces must be thoughtful, lawful, and trauma‑informed. My amendments were written with that in mind.

The amendments I proposed were an attempt to address the two very different interpretations of the current policy that have emerged across the district. The goal is to bring everyone together in a reasonable compromise that prioritizes student safety above all else.

If you are for Keeping the current policy in place and strengthen it against potential litigation by clarifying the language, then consider signing this petition.

I appreciate that the petition suggests amendments which could potentially reduce liability over this issue. I am really glad that 72% of the signatures are actually coming from our district. I know there was an alternative petition going around that seems to have signatures from people outside of our district, as well as a few that are in our district. I know there is no perfect solution. Speaking as an individual member of the Board of Education, I am open to revisions and finding the best possible solutions to respect the privacy and dignity of all students. JBAA as it currently stands does offer a single occupancy non gendered bathroom in each building. That complies with the verbiage in HB 23-1057 as follows: (d) REQUIRING ALL SINGLE-STALL RESTROOMS TO BE DESIGNATED FOR USE BY ANY GENDER REDUCES WAIT TIMES AND INCREASES COMFORT AND ACCESSIBILITY FOR CARE PROVIDERS AND PEOPLE RECEIVING CARE, INDIVIDUALS WITH DIVERSE GENDER EXPRESSIONS, AND LGBT INDIVIDUALS. FOR LGBT INDIVIDUALS OR INDIVIDUALS WITH DIVERSE GENDER EXPRESSIONS, USING GENDERED FACILITIES CAN POSE HEALTH AND SAFETY ISSUES STEMMING FROM EXPERIENCES OF HARASSMENT AND PHYSICAL THREATS IN GENDERED FACILITIES REGARDLESS OF WHICH GENDERED FACILITY THEY USE OR THEIR PHYSICAL PRESENTATION. DUE TO THESE EXPERIENCES AND ASSOCIATED STIGMA, SOME PEOPLE AVOID USING PUBLIC RESTROOMS WHENEVER POSSIBLE AND MAY REFRAIN FROM EATING, DRINKING, OR RELIEVING THEMSELVES FOR EXTENDED PERIODS OF TIME IN ORDER TO AVOID GENDERED FACILITIES.
