The Issue

 

WHAT IS THE CRIMINAL JUSTICE SYSTEM?

To reform the criminal justice system, we must first ask ourselves. What is the Criminal Justice system? Sometimes asking the right questions solicits or provokes the most logical answers. In this case, we’re approaching a part of our Republic that desperately needs a real solution and that’s Criminal Justice Reform. Approaching the subject sincerely is the proper way to resolve a problem that seems huge but really isn’t. In reality, time and experience dictate the correct path to the reform that protects the Republic and its Citizens. What’s lacking is honor and integrity.

The criminal justice system is a major part of the Republic. Because Our Republic, is based upon a Moral Agreement rooted in the Declaration of Independence. Every American who claims part and partial of this Great Nation agrees to this Moral Agreement whether they are conscious or unconscious of it. Ignorance of the Natural Law, which is to “do unto others as you would have others do unto you”, is no excuse.

This Natural Law wakes up with us and goes to sleep with us. This Moral Agreement is the fundamental contract we make with one another under one of the greatest documents of all time, the Constitution of the United States of America. When approached from this perspective it is easy to implement the reforms necessary to protect ourselves from ourselves, and others within the Republic, and without it.

Furthermore, this approach will not only bring about the reforms that are necessary. But it will also expose our servants whom we entrust with the power and authority to enforce the Moral Agreement upon themselves and those of us who breach the contract.

So, what is the Criminal Justice System? In essence it is the police, prosecutor, defense counsel, and the judge. It is these four entities that breathe life into the entire system. They are the gatekeepers. The people we trust to enforce the Moral Agreement breached by the accused person. You and I rely upon them, and they hold a sacred trust in the administration of Justice.

POLICE, PROSECUTOR, DEFENSE COUNSEL, JUDGE

Police and Prosecutors wield significant power in the criminal legal system, from what evidence to present to whether to disclose favorable evidence to the defense. Whether in error or through intentional misconduct, these actions undermine accuracy in criminal trials and contribute to wrongful convictions at unacceptably high rates. Under current U.S. law, prosecutors are almost entirely immune from civil lawsuits even when they intentionally violate laws. Existing grievance processes in many states are ineffective and inefficient, often permitting “serial offenders” to continue their misconduct. Additionally, many courts and defense counsel are reluctant to refer even serious cases of apparent misconduct to existing grievance entities either because the allegations can take a long time to resolve or due to a lack of confidence in the current system’s integrity. Or because defense counsel and the Judge are involved in the wrongful conviction themselves as demonstrated in the Roscetti4 case.

To strengthen police, prosecutorial, defense counsel, and judicial oversight and accountability, we are advocating something that will be totally within our power to do, legislation. 

The picture presented herein is encapsulated in the powerful book, “The Kids Who Cried Wolf: The Roscetti case.” The malicious conduct of the police, prosecutors, Defense Counsel, and the Judge in conspiring knowingly, to send four innocent teenagers to death (i.e., Life with no possibility of parole), should never be forgotten. 

These types of monsters who violated the trust of the victim, her family, and her friends should never be forgotten. Just think about it. You and I relied upon their sacred honor to the Republic and their conduct is evidence of their total disregard for the Moral Agreement and most IMPORTANTLY, the consequences. Why? Listen closely.

I say this as if Lori Roscetti is whispering to me in my ear, right now. “There are no consequences.”

How can we talk about reform in criminal justice? Where, statistics clearly demonstrate the leading causes of wrongful convictions are:

• Official misconduct (28 cases, 82.4%)
• Perjury or false accusation (26 cases, 76.5%)
• False or misleading forensic evidence (11 cases, 32.4%)
• Inadequate legal defense (8 cases, 23.5%)
• False or fabricated confession (6 cases, 17.6%)
• Mistaken eyewitness identification (4 cases, 11.8%)

What are we going to do about this? How can we immediately have an impact on Criminal Justice Reform, that would and should terrorize those we trust to administer the system properly?

Consequences state and federal, that’s how! Consequences, that include prison time for those found guilty of the “The Roscetti4 Act.” Anyone found guilty of knowingly or intentionally sending an innocent person to jail/prison or attempting to send an innocent person to jail/prison, will in fact face prison time themselves for breach of the Moral Agreement and their duty to the Republic and the public.

This doesn’t require long dissertations or criminal scholarships nor professional debate. Rather, simple common sense. Someone, I don’t believe life was taken in vain, Lori’s. I have fulfilled the first part of that promise. What was that promise?

Not to give up until the real killers were apprehended. We caught them both and they both died in prison for what they did to Lori. Now it’s time to make those who deliberately send innocent people to prison run from this sacred post (i.e., Criminal Justice). These types of laws will attract honorable citizens to this post.
