Create Right To Disconnect Law In India
The Issue
Petition: Introduce a "Right to Disconnect" Law in India
To: The Ministry of Labour & Employment, Government of India
Subject: Protect Employees’ Right to Disconnect from Work After Hours
We, the undersigned, urge the Ministry of Labour & Employment to introduce a "Right to Disconnect" law in India.
This law would give employees the legal right to refuse work-related communication outside of their regular working hours, ensuring a healthier work-life balance and protecting mental well-being.
Why Is This Law Necessary?
India has one of the highest rates of overwork and burnout, with employees often expected to remain available beyond their contracted hours. With the rise of remote work and digital communication, boundaries between professional and personal life have blurred, leading to:
Increased unpaid work hours
Mental health struggles, including stress and anxiety.
Disrupted personal and family time
Reduced productivity and job satisfaction.
How Would the Law Work?
Similar to Australia's recently passed "Right to Disconnect" law, this legislation should:
Allow employees to refuse work-related calls, emails, and messages after working hours unless contractually obligated.
Consider the nature of the request and the employee's personal circumstances when determining if a refusal is reasonable.
Provide a dispute resolution mechanism to protect employees from unfair retaliation.
Promote a culture of respect for personal time, leading to better mental and physical well-being.
Global Precedents:
Countries like France, Spain, Italy, Belgium, and Portugal have already implemented similar laws. Australia recently passed its "Right to Disconnect" law, setting an example for progressive labour policies worldwide.
Our Request:
We call upon the Ministry of Labour & Employment to introduce legislation in India that:
Recognizes employees' right to disconnect from work outside regular hours.
Protects employees from retaliation for exercising this right.
Encourages organizations to establish clear policies on work-related communication after hours.
By enacting this law, India can take a significant step toward improving workplace culture, reducing stress-related illnesses, and ensuring fair working conditions.
