Create accountability for judges and attorneys”

The Issue

In many states, the office of disciplinary counsel is the only entity that governs the conduct of judges and attorneys. This ODC panel is made up of other attorneys who may have the desire to be judges. Often thorough investigations aren’t done and no communication or rubric is provided as to what the details of the investigation were. No one wants to reprimand their colleagues, many fear retribution, and many can’t admit to wrongdoing or errors made. The statistical data of complaints on attorneys vs the number reprimanded are extremely shocking facts. Do your own research. Accountability needs to be placed on everyone especially those with power and political opportunities. Panels needs to play a role in investigating and provide a clear list of documents read, phone calls made, evidence looked at, etc. How do you know someone didn’t drop the ball if no details are provided? Every attorney should have an evaluation filled out that the ODC monitors to ensure quality ethical conduct in addition to work flow evaluations.  Complaints of attorneys can’t just be heard by other attorneys. Those in powerful positions, who make important decisions, should be held to the highest of accountability standards not by their own colleagues. A diversified group  of individuals from various careers as well as seasoned attorneys in the field should collaborate and make decisions on conduct violations. Standards and criteria for conduct should be reviewed and be a part of professional development. Investigators should do “walk throughs without notice, have access to reviews, be privy to all court transcripts, etc.” No one should get paid hundreds of dollars an hour and have this much power without being held to rigorous standards.  Power, prestige, and wealth should not play a role in obtaining favors in court. The panel who makes regulations for attorneys and investigate them should consist of various races, ages, professions, socioeconomic backgrounds, religions, immigration status, etc. Let’s try to help those that make critical decisions take their time, not rush, seek all evidence, be peaceful, and not take moody behavior into a courtroom. Let’s make every attorney take an oath to tell the truth, the whole truth, and nothing but the truth as well.  Middle class and the poor people don’t have access or the resources for attorneys like the wealthy do.
