CPS: Stop Violating American Family's Constitutional Rights
The Issue
On March 26, 2012 at the midst of my wife 40th birthday, Teresa Hackney Lewis was terrified when a caseworker from the Child Protective Services came on her that evening to take our two children based on one anonymous phone call for the allegations of child abuse and neglect.
The Child Protective Services Investigator Specialist IV, Kasey M. Arnold, appeared at our house around 9:30pm after her office hours. Kasey stated that she tried to call my wife's cell and that her voice-mail was full.
Kasey did not give my wife Teresa any indication that she was going to show up at our house that evening. My wife did not receive a letter from Kasey that stated she was going to appear.
Kasey violated and denied our constitutional rights by taking our children without a warrant from the judge, just because she felt that our children were in "imminent danger" based on one anonymous call.
Kasey also violated and denied our children's constitutional rights to have a parent present while being interviewed.
My family was operating under the Color of Law during that time.
Child abuse allegations are not a crime. They are neither a civil case, especially when the allegations were made anonymously.
The Child Protective Services and Kacey M. Arnold has done psychological damages to my wife, our kids and myself.
No parent or step-parent in this country have to go through this terrible and unjustified ordeal without a probably cause for a warrant from a judge and to guaranteed the protection of our individual constitutional rights in due process of law.
My wife and I are fighting to defend our constitutional rights and the rights of thousand of American families to protect our children from the tyranny of Child Protective Services.
