The Issue

My son Isaiah Gilbert was wrongfully convicted.  Please join me in fighting for his life.

Isaiah was arrested 2 days before his 20th birthday and was given a life sentence. My son has lived in a 6x8 ft cell for over 10 years.  So far, he has missed 15 birthdays, 15 Thanksgiving, 15 Christmases, the births/deaths of family members and so much more. It’s agonizing to know that my son is in prison for life, despite being innocent, based on lack of evidence, little to no investigation, fabricated lies and grossly inadequate representation. 5,504 (and counting) days is too long to suffer unjustly.

Before Isaiah was railroaded for this crime, he was establishing his life as a young adult. He was working at a restaurant called Cheezie’s pizza and in the process of enrolling in Tulsa Tech’s welding program. I was proud of the choices he was making, and he was on track to be a successful young man.

That all changed on May 18th, 2010, when his brother dropped him off for his shift at Cheezie’s pizza. Upon getting out of the car and before he was even told what was happening, Isaiah was maced, mauled by a police dog, and arrested. When they arrived at the police station, it is noted in police reports that Isaiah was still under the effects of the pepper spray and in excruciating pain from multiple dog bites, but detectives proceeded to question him after his arrest.

It is very evident that Isaiah and the victim of this crime were failed in multiple ways including:

  • There is no physical evidence connecting him to this crime. There were 4 different shell casings on the scene, beer cans, and cigarettes tested for DNA. DNA was found and tested against Isaiah. It did not match.
  • Isaiah does not know the victim. He has never met or had any dealings with anyone in the Daniel’s family.
  • Isaiah had an all-white jury.  His murder trial lasted one day. The jury deliberated for a short amount of time and came back the same day with a guilty verdict.
  • The prosecution only presented circumstantial evidence held together by weak glue of assumptions. No one testified to seeing him shoot the victim. An complete investigation was not executed. Isaiah was arrested less than 12 hours later. Despite several different shell casings being found on the scene, nobody else was arrested. No murder weapon was ever found. There was never any attempt to search for any weapons or clothing at his home.
  • He was convicted solely on testimony from 2 witnesses. The star witness has come forward and admitted to giving false statements at trial.  The other witness (Isaiah’s former classmate) testified that she did not see my son possess a gun or shoot anyone.
  • Newly discovered witnesses have come forward in defense of Isaiah. He was not present at the time of this shooting, and many have come forward to confirm that. Besides the star witness, other members of the victim’s family that were present during the shooting confirmed that he was not the shooter.

Why does it take 20+ years to correct the errors in our justice system? My son is innocent and should be home. It is not JUSTICE for this family if an innocent person is in prison!

Please join me in fighting for my son’s freedom! Thank you for signing this petition!
