Repeal Vaccination Mandate for Construction Workers Victoria
The issue
It is possible to reverse mandates and legislation, but they can only be repealed by subsequent ones to replace them, when the courts declare a law to be inconsistent with the constitution. The former law or mandate (e.g. mandatory vaccinations for Construction Workers in this case) shall be void and the latter shall govern.
The Vaccination Mandate announced by Victoria's Chief Health Minister, is incompatible with human rights set out in the charter (Charter of Human Rights and Responsibilities Act 2006). Furthermore, the mandate is incompatible with The Australian Constitution.
It is in breach and violation of Section 10 of the Charter Protection from torture and cruel, inhuman or degrading treatment.
- A person must not be— (a) subjected to torture; or (b) treated or punished in a cruel, inhuman or degrading way; or (c) subjected to medical or scientific experimentation or treatment without his or her full, free and informed consent.
It is also in breach of S51(xxiiiA) of the Constitution, which "provides an express constitutional protection against forced medication.”
Further to the above breeches, the 10th Edition of the Australian Governments’ Immunisation Handbook Section 2.1.3 states: legally valid consent can occur only “in the absence of undue pressure, coercion or manipulation”. As this mandate could be classified as coercion, manipulation and fall under undue pressure, consent may not be legally valid by all who take the vaccine.
This petition advocates to repeal the newly implemented mandate to vaccinate all Construction Workers, and replace it with legislation to a similar following effect, that takes into consideration the rights of all Construction Workers:
- Unvaccinated construction workers required to pass a negative COVID test OR:
- Construction Workers are recommended to take the vaccine OR:
- Prove natural immunity to the COVID virus, whereby they have contracted and fully recovered from the COVID virus
Natural immunity should be considered as a valid exemption as there are now several academic studies that support natural immunity providing reliable protection against COVID. For example, a new study from Israel suggests immunity gained after recovering from a bout of COVID-19 is more protective against the new Delta variant than vaccine-induced immunity. Natural immunity was estimated to be about 13 times stronger than having two doses of the Pfizer-BioNTech vaccine.
