Constitutional Amendment Limiting Presidential Immunity
The Issue
Amendment XXVIII
Section 1. The President of the United States shall be subject to civil and criminal liability for actions taken during their term in office, whether such actions are official or personal.
Section 2. In the event that civil or criminal proceedings are initiated against the President, the Vice President shall immediately assume the powers and duties of the President as Acting President under the provisions of this amendment until the proceedings are fully resolved or suspended, or the President is acquitted.
Section 3. During the period in which the Vice President is Acting President, the President shall retain the title but shall have no powers or duties associated with the office. The Vice President, acting as President, shall perform all responsibilities and functions of the office.
Section 4. The President shall not be immune from impeachment by the House of Representatives and trial and removal from office by the Senate, as provided in Article I, Sections 2 and 3 of the Constitution.
Section 5. This amendment shall not be construed to alter the principle that no person, including the President, is above the law. Any statutory or common law immunities or privileges previously applicable to the President shall be nullified by this amendment.
Section 6. Congress shall have the power to enforce and implement this amendment through appropriate legislation.
