1.     This lawsuit displays the illegal and unethical manner of the new mandate purportedly authorized by Public Health Law 201, 206 and 225.

2.     The Petitioners within the lawsuit respectfully request the Court to issue a Judgment and Order:

a.     decreeing that the Mask Mandate Regulation and Statewide Mask Mandate Policy were enacted in excess of Respondents’ constitutional, statutory, and administrative authority, are arbitrary and capricious, and are vacated, null and void.

b.     permanently enjoining Respondents from enforcing the Mask Mandate Regulation and Statewide Mask Mandate Policy.

c.     granting such further and other relief as the Court may deem just and proper.  This includes the potential to mandate the COVID-19 vaccine.

3.     The lawsuit has a current fee of upwards $100,000 which will be divided amongst the Petitioners of the Court.
