The residents of Connerton are Petitioning for change to the HOA restrictions.  The residents of Connerton are asking the HOA to re-evaluate the rules against above ground spas, hot tubs and swim spas throughout the Connerton Community, as Residents would like the option to be able to have an above-ground spa / swim spa in the privacy of their own backyards.
This is an absolute necessity for some residents whom are disabled, have been diagnosed with an auto immune disease, and some disabled veterans that cannot carry out other forms of cardio outside of swimming and simply for personal enjoyment in the freedom of their Backyard.  A Spa / Hot tub or Swim Spa is less invasive to a yard than having an in-ground pool, where in-ground pools have a lengthy construction time, require digging that can affect the grounds around the construction site and are an eyesore in the community for months during installation.  It’s a quick & easy way to relax and enjoy the comfort of your own home & privacy of your own backyard and doesn’t disturb orhers. 

An above-ground spa/swim spa will take 1-7 days to install and require no digging. The approval of this petition will also allow for families to have a less expensive option for leisure and exercise for residents if they cannot afford the large cost of an in-ground pool installation and don’t want to wait multiple months to have this commodity. Spas/Swim Spas installed should be at a height that is lower than their surrounding fence, as this will allow no intrusion on their neighbors.  It should also be an option to be submitted for approval as a regular ARC request. 
 
Note: There are many items in the HOA for this community that allow residents to have structures in their yards that surpass the height of a resident’s fence. An above-ground spa/swim spa will not surpass the height of the resident’s surrounding fence and shouldn’t be prohibited.  The only way a neighbor would see the swim spa is by using a drone, standing on a ladder in the back yard may allow for visual access to all yards surrounding a home. Additional situations like this would include working on a roof, installing Christmas lights, maintaining trees and some two story homes in the community that have second story windows that allow visual access to other resident’s backyards. An above-ground spa/swim spa should be allowed for residents to have in their backyards. This rule needs to be changed to accommodate the desires of the residents & shouldn’t be unanimously disapproved based on rules that are outdated and didn’t have community input when being created.
