Keep Unemployment Benefits Under CARES ACT & ARP Law.

The Issue

Several Republican governors are in violation of federal laws set in place to serve the public during a pandemic. We feel these governors have abused their executive powers given during the state of emergency due to infectious disease. The emergency has not officially ended and to support that claim are the federal laws in place, the CARES ACT and American Rescue Plan. Under these emergency powers include authority normally reserved for legislatures, such as the ability to suspend existing statutes or effectively create new laws—albeit temporarily and only as needed to respond *to the emergency situation*. Suspending vital financial assistance given by law under the CARES Act and ARP, is a breech of public trust and undermines the separation of powers vital to our democratic system. How is it that so many governors are able to circumvent federal law on factually unfounded claims without oversight? In turn causing unnecessary financial harm during this emergency! Suspension of vital funds allocated to the people as a result of a virus pandemic is an infringement of the rights and liberty given to us by law of the President of the United States. Governors do not have the power to alter federal laws even under emergency authority.

Statutes defining executive authority during an emergency cannot be modified by executive order nor at a whim. Governors cannot promulgate emergency rules that grant themselves authority beyond the statutory limits, even if they otherwise have the power to temporarily alter statutes. Furthermore any guaranteed rights remain in full effect during an emergency. To confiscate funding meant to help Americans is also morally repugnant.

-The CARES Act, Paycheck Protection Program and, Healthcare Enhancement Act (PPHEA) that supplied additional funding to programs under the CARES Act—disbursed approximately $2.7 trillion in relief funding across the economy. This relief included hundreds of billions of dollars in payments and loans for all types of businesses. The programs established under the Act require varied certifications and come with conditions and requirements that dictate whether and how program funds may be distributed to, used, and in some cases, kept without repayment, by recipients. 

We are asking the Pandemic Response Accountability Committee, the Special Inspector General for Pandemic Recovery, and the Congressional Oversight Commission to step in and do their jobs in enforcing the laws meant to serve the public afflicted by this ongoing pandemic. ALL Governors should have been directing their states’ resources where they are needed most and where they will achieve the greatest impact, however under the guise of workforce development some governors believe they can take already allocated federal funds to bribe folks back into unsafe jobs. The news was not widely known about the workforce $2,000 bonuses so those who had wished to participate no longer qualify as the deadline has passed. Childcare for one child might cost $2,000 for the month, people who do not have nanny’s understand that the cost of child care in a safe environment is costly. One month’s rent is typically $1,200-$1,600+, mortgages vary as well. It is not enough and it sets us up multi families and individualsto fail. Regardless the CARES ACT and AMERICAN RESCUE PLAN strictly express how government funds are meant to be distributed. To the people. As practical problem solvers, Governors are to effectively deliver state and federal services to protect public health and to stimulate economic recovery and growth. The unemployment stimulus was set to end by fall September 6th 2021. Instead governors have selfishly pulled out of emergency federal funding and violated those laws by the time our children are set to start their summer vacation. June 10th. Some children do not qualify at age to be vaccinated against the novel Coronavirus Covid-19. Parents and people have to make abrupt and unstable decisions to find gainful employment or risk taking employment that still endangers their families and those around them. Daycare facilities are not fully operational as the pandemic wains on with merely 36% of the population vaccinated. The majority of children legally required supervision are below the age of 12. With the great losses of once dependable family members because of the virus, many do not have the strong support system in place. We only wish for unemployment to run its natural course unimpeded by those who live full time off of our tax payer dollars; claiming to serve the public as government officials.

Millions of Americans are going to be effected by these state governs whom prematurely  acted on their own against the people they served wises to deny assistance and time we desperately count on. Americans across the country are still burying their lost loved ones, still caring for those dependent on them because circumstances keep abruptly changing. Children have yet had the time to mentally adjust to change in their own home as they’ve gone back to in school learning since, but now have to face a lonely, stressful summer. Please allot us all this time to adjust, to get in order what needs to be done so that in turn we do not neglect our responsibilities because of financial choices forced to be made. Imagine a single parent who has stayed safe throughout this pandemic, had time to search for a career that fits into them and their child’s life so that then without further pandemic assistance is able to take care of life and really provide independently. Some folks are sick with covid, some folk will become sick with Covid before the end of the month, some are struggling with long Covid, or other ailments. If this is our new normal, rushing to end one of the few avenues of support we have left will likely create further hardship.

Arizona The powers granted the governor with respect to a state of emergency shall terminate if the legislature is not in session and the governor, within 24 hours after the beginning of such state of emergency, has not issued a call for an immediate special session of the legislature for the purpose of legislating on subjects relating to such state of emergency. The powers granted the governor by this chapter with respect to a non-state of war emergency shall terminate by proclamation of the governor or by concurrent resolution of the legislature declaring it at an end. Ariz. Rev. Stat. Ann. § 26-303.
