Appeal for Legal Assistance for Military / Veterans

Veterans Life Matters
Asheville, North Carolina
September 2021

A very good day to you Ladies and Gentlemen,

My name is Jeff Powell and before I begin with my humble yet sincere and heartfelt request, I would like to thank you in advance for supporting the Veterans Community.

Next, Ladies and Gentlemen...

There are anywhere between 20 to 35,000 Homeless Veterans living on our American streets and for the most part, these brave and courageous men and women should not, and do not, have to be in the horrific position of being homeless.

In addition, and often more damaging to both character and livelihood, our Veterans shouldn't have to endure any unjust and/or unfair legal situations and proceedings that don't only harm the Veterans, but such detrimental and tragic circumstances often harm and negatively affect their communities as well.

Veterans who've gone before us, and who have taken steps beyond the call of duty, also play an essential part in our communities and, as a Veteran myself, I've personally felt and seen the hardships that cause Veterans to become homeless.

As a matter of fact I am experiencing such a hardship right now and feel compelled to take action in every way I can, to hopefully bring this matter to light and find solutions and support for the Veteran Community as a whole.

The high cost of representation and legal defense for any legal proceedings brought against Veterans is simply prohibitive for most, and the impacts and outcomes can be devastating.

In my case, an unfounded and unfair custody case, initiated by a non-parent this past 31 May 2021 [Memorial Day], Filed 2 June 2021, now sees my son and I in a desperate situation and on the brink of becoming homeless as well as not being able to receive any support nor food assistance already approved by the Food and Nutrition Agency during the month of July 2021.

Such unfairness, compounded by matters such as the nonconsensual release of (often false, irrelevant, or damaging) medical information to the courts for public review, isn't only destructive to a Veteran’s character, but just as harmful to the Veteran’s safety, wellbeing, and livelihood - and can have a severe negative effect on other opportunities as well.

Ladies and Gentlemen, our Veterans deserve the very same legal fairness and opportunities that everyone else enjoy, but this is so seldom the case. These courageous men and women have helped secure the opportunity of freedom for everyone, and taking spiteful or unfounded legal action against our (mostly) law-abiding Veterans costs thousands upon thousands of dollars for legal representation to resolve.

In most cases, this is money (or resources) Veteran/s simply do not have, and our Veterans are thus often forced to endure devastating financial results.

Thus, I am respectfully asking everyone who cares about our Veterans to call and/or write our Elective Officials and ask them to introduce and support a Bill that support certain Legal Expenses, as well as stopping unjustified legal proceedings brought against our Veterans, so that their lives and livelihoods are not so unlawfully and so negatively affected.

These are the very hardships that are robbing so many of our Veterans of the American Dream - the very dream they have helped protect and secure - and the equal opportunity of having a decent place (shelter) to live, along with an enjoyable lifestyle so many others are privileged with.

Ask our Elective Officials to review, vote and pass a Bill that is fair for our Veterans - a "Legal Expenses Bill” or something similar - that will help pay Attorneys’ fees for those legal expenses that are unaffordable but rightfully and equally as important for our Veterans to have legal fairness on their side. The very fairness that everyone should have, something affordable to counter and contest unfair and costly legal proceedings such as custody, defamation of character and other cases that detrimentally affect the very livelihoods of those who've rendered their selves in serving and providing opportunities for everyone.

Ask our Elective Officials to also provide more support to our HIPAA (Health Insurance Portability and Accountability Act of 1996) Laws - a Federal Law that required the creation of national standards to protect sensitive patient health information from being disclosed without the patient's consent or knowledge - so that our Judicial System will not be overwhelmed by bias in nonconsensual medical information claims that do not have any standings or merit.

Ladies and Gentlemen, asking for help and sharing helpful information and resources is essential for our Veterans’ wellbeing, and is a fundamental aspect of their needs and rights. Asking isn't anything bad or hard. Asking for help and sharing information and resources is important, and for the improvement of so many things - such as being able to select an Attorney who is willing to represent a Veteran, or even provide Pro Bono case defense; or something as simple as having groups sponsor Veterans who need resources for important legal cases that, simultaneously and beneficially, uphold and protect their rights.

Our Veterans’ livelihoods and wellbeing shouldn't ever have to suffer the devastating effects of false and misleading information and proceedings that could cost them and their loved ones the very homes they live in - and for many Veterans their place of residence is the only safety net they have.

Honestly, our Veterans have dealt with some of the most horrific crises ever and it makes no sense to see those who've helped so many suffer so much.

I feel it is our duty and moral obligation to give this matter the highest attention it deserves. It is up to us to bring it to the attention of our State and Federal Elective Officials. It is up to us to tell our friends, family members and coworkers to support this cause, and that our Veterans need and deserve all the help we can give them.

Tell everyone that [Veterans Lives Matters] and that our Veterans’ livelihoods, legal representations, and rights should be protected.

Together, with a united voice, we can undoubtedly drive huge positive change through united action!

Among these issues, I feel strongly that it should be unlawful to:

* Make false statements to Law Enforcement to take custody of a child. This is tantamount to Child Abduction or Attempted Kidnapping.
* Report false malice and misleading information to the Courts and other Federal or State Agencies to gain custody of a child.
* File Emergency Court Orders against a Veteran under false pretenses.
* Threatening harassing and or intimidate a Veteran with Law Enforcement to obtain their child/ren and or property rather physical or intellectual.
*Threaten a Veteran in front of Law Enforcement if the Veteran/s did not comply with unlawful commands.
* Receive tax and or other benefits regarding a Veterans child/ren.
* Or for a Habitual Felon and or a group of individuals to intrude and or attempt to intrude into a Veterans home to abduct his or her child/ren
* Falsely informing Law Enforcement that there are Court Orders of Custody to obtain physical custody of Child/ren at hand.
* Threatening a Veteran by any means with Law Enforcement if the Veteran/s parent/s go to Court in defense.
* Blocking and or delaying a Veterans mail for [any] reason or means.
