The Issue
Subject:- Application to stop cutting of trees for Commercial extraction of Diamonds in M.P.
Respected Sir,
This is respectfully submitted that, to the concerned authorities as following:-
1. That, In Buxwaha, Chhatarpur District of M.P, India, a project has been sanctioned by the Government for extraction of Diamonds and it is estimated that Diamonds over Crore’s shall be found here but this shall be done at the cost of Lakhs of Tress. For the project to start and to bring the Diamonds available for sale by the respective Company engaged in its extraction a minimum of 2.5 lakh trees shall have to be cut down, these also include some very valuable endangered species of trees and the natural ecosystem shall be disturbed by this venture.
2. That, the natural Resources of the Country are not a private property on any single individual or community alone, It is a gift of nature to the natives of the country altogether. The resources be available to any limit are always considered as scarce as economics as a queen of all social sciences states that wants are unlimited while Resources which satisfy those wants are limited and scarce and also take hundreds of years to Replenish.
3. That, we are at a stage where we need to opt for a Sustainable development according to which the present needs should be fulfilled keeping in minds the needs of tomorrow. If we somehow are adamant on fulfilling our greed instead of need, these scarce resources will deplete in a couple of years and will also affect the environment adversely. All over the world, we are coming across problems of Pollution, deforestation, Global warming, Loss of Flora and Fauna, Change in Climatic Conditions, Diseases Caused due to pollution and disturbance in Natural Habitat, Many of the rare species of plant and animals are endangered and some of them have even become extinct. We are watching them in pictures and images but to see them in real is a matter impossible in current situation. Likewise, what we have today shall be extinct for our coming generation and even they shall feel that our forefathers have given us a place to live where the atmosphere is toxic, hydrosphere is toxic and moreover Lithosphere is toxic, where does the life exist then.
4. That, We are living in 21st century where we are so developed, that we are looking for possibility of life in Mars and other planets. In Primary classes it is taught that life is possible on Earth mainly for three things:-
i. Air (Atmosphere)
ii. Water (Hydrosphere)
iii. Land (Lithosphere)
While a combination of all three is Biosphere (Life Supporting), in other words, they collectively bring life possible on this earth. Flora (Plant) and Fauna (animals including Humans) form the ecosystem and there is a natural balance between them along the Food Chain. It is clearly evident that any change in natural balance of this food chain or ecosystem can be traced all over the food chain causing problems like Biomagnification which means that since we stand on a higher platform in the food chain, the toxicity level is highest and most dangerous for ourselves. What we give and the way we disturb the ecosystem is reflected back to us a million times back to us.
5. That, in Various Conferences and Treaties, It has been decided all over the world that collective measures shall be taken to control pollution as global warming and ozone layer depletion due to Excessive use of Hydrocarbons and CFC’s is a serious threat to the Entire World and not to any country alone. Moreover, the coastal areas are on the verge of sinking as the water level is increasing due to melting up of Ice Caps at the poles including Antarctica. United Nation Itself has made provisions for Maritime ocean belts and has clearly mentioned that air and water bodies do not belong to any single entity, community or country alone, these belong to everybody and it’s our collective duty as a Citizen and also as a human Being to protect them.
6. That, many of the rare species of plant and animal have become extinct and many of them are on the verge of being extinct, efforts are been made for captive breeding and other measures are been taken to protect them by hook or crook and all Governments including India has provisions for the same. Criminal actions for Poaching and Hunting of animals for fun or their valuable body parts has been provided by Law domestically and also in International Law. Many of the Rivers Like Ganga has been given the status of Natural Person by The Hon’ble Supreme Court in order to protect it from Pollution and orders clearly state legal action on its violation. Various guidelines have been issued at various places to control harmful effects of pollution, Taj Mahal is a remarkable example in the same series.
7. That, the pollution level has been raised to such alarming rate that, Government of India has initiated Swach Bharat Abhiyan, to curb the use of plastic and make India a clean place worth living. Statistics have been issued to declare the most clean and most polluted cities in India. Delhi and Kanpur Stand on the top of this list where breathing in open air is equal to taking in Cobra poison and in no standard there atmosphere is supporting a healthy life there. Deforestation and its harmful effects are no where hidden from anyone on this earth from our early childhood we are taught that plants at every level are Man’s best friend. They provide us with oxygen, food, medicine and almost in every sphere of life trees stand on an equal on indeed on a higher platform for survival of life. Control of Pollution would definitely be impossible if there were no trees.
8. That, change in climatic conditions, Low rain and extreme rise in temperature are another serious drawback faced by population of the country. In Lucknow itself, many of parks and tourist places were built using the valuable resources including marble and stones from Jaipur. Years of Hard work made the pace beautiful, but in Summers there is not even a single tree for shade. Due to hot weather in Summers even if a person or animal etc tries to move that way, the only intention in his heart is how fast can I cross this furnace as its nearly impossible to breath or even stand at a single place due to heat because of the marbles which become extremely hot due to heat of the Sun. Moreover, the rain patterns have changed causing a serious threat to the agriculture and also a fall in food and raw material to the Industrial Sector. The valuable resources could have been utilized for health, education or some productive use which would have given employment to the youth to curb the crime rate. Youth even if educated has no work to do and hence can be easily diverted to other unlawful activities including liquor and weeds etc which is again a harm to the Human Resource of the country. The youth is the
face of the nation, indulging in unlawful activities and addictive things is on one hand making him unproductive on one hand and making him a burden on society and on the other hand also we need resources and system to stop and prevent him from unlawful activities to reduce the burden of law and order.
9. That, in India we have a number of examples where people have collectively stand as one while forgetting the differences of caste, creed, color, sex, religion for a common cause. The prominent example is the struggle of freedom from Bruisers. When everyone felt a patriotic feeling and things had gone below the level of tolerance they had to stand unanimously against the external force to protect the Indian Culture from the clutches of Bruisers. History shows many of our eminent ideals including Ashoka. Ashok Stambh the national emblem is been adopted from the same stupa built by Ashoka after the battle of Kalinga (modern Odisa) where, after his victory his inner soul cursed him. What had he won, dead bodies, cries of the left families, orphan children. He was shocked to his senses and he gave up fighting and adopted Buddhism and sent his son Mahendra and Daughter Sanghamitra in propagation of peace. Genocide at such high level also not allowed by any domestic or even International Law. Establishment of UN, and bodies to prevent wars after the two World wars and its after destruction, are important steps in the same series. Another incident involves a similar problem where people hugged the trees in order to prevent cutting of trees in Tehri, Garhwal, popularly known as Chipko Movement, under the leadership of Sundar Lal Bahuguna which was later awarded and also appreciated by the Government for community involvement in protection of the nature.
10. That, India and the world has seen a number of Natural calamities, tsunami in India, earthquakes, Landslides volcanic eruptions etc and also other disasters are not affecting any single person or community. These are warnings of nature to control the man made disturbances in balance of nature. The effects will otherwise be seen through generations and which are irreversible and cause mutation in genes itself. The Atom Bomb in Hiroshima and NagaSaki are evident examples of same. The generations born there are still genetically in affect of that epidemic till today. Latest example, Covid-19 shook the world and completely brought the world to a halt. Crore’s of People Died abruptly, medical science and Governments including developed Countries Like USA could not find a probable solution, India having second largest population of the World is still struggling to save lives and a heavy oxygen demand is creating a problem for the Government and the families of the Victims. Crore’s of people have lost their lives their source of livelihood and are forced to stay in homes with masks. Any medical emergency is not been able to help the people as they are losing their lives in ambulances in lack of oxygen and in a span of time until reaching or finding medical help. The cementation Centers are full of dead bodies and resources fail short to dispose dead bodies, family members are unable to see their loved once before crème nation, Dead bodies are floating on Rivers, Dogs are tearing dead Bodies on Road, Even Judges and Political leaders were not given proper help and they lost their lives. Every industry was adversely affected and people had to stay hungry and think for food and their survival. Is this the place we dream? Is this a place worth Living? Is this the Fundamental Right of Life and Personal liberty Under Article 21 of the Indian Constitution? Is this the cost of development and technical advancement?
11. That, courts have been shut and complete building have to be sanitized in order to protect the lives of people. Police on watching any person roaming on roads runs to hit his back with stick, Thousands of false challan were made to control movements of public, Festivals and marriage permissions were cancelled or allowed with only 20 people. As such there was no money or earning with public and making such drastic control over public was needed to save their life. Even medical movement was charged with challans, people started black marketing and stocking of medical equipments and oxygen cylinders. Law and Courts which were treated as independent wing of the Government stood as a watch dog with folded hands as nothing could be done rather than just wait and hope for the conditions to improve. Slum areas, lawyers and many sections of society were failed to be given any help and the community which was hand to mouth was forcibly locked behind doors to protect them from this epidemic since medical facilities were as such less and Government in no doubt failed to estimate the real situation and its drastic effect.
12. That, under such uneven circumstances, the cutting down of more than 2.5 lakh trees is utterly stupid and non logical decision of the Government which in no way is beneficial for the public. What will the people do with diamonds even if they don’t have oxygen to breath, what is the purpose of surplus profits and increased per capita income if there are no one alive to use the profit. It is very politely and respectfully requested to the concerned authorities that even if the natural resources have been found they shall remain with us even if not been extracted and once the situation is under control and we all collectively plant at least 25 lakh trees to take the position of the jungle once again and also selective cutting of patches of land for extraction of natural resources, the current cutting down of tress shall be stopped and Hon’ble Supreme Court shall in the interest of national health and protection of Human and Fundamental rights of the people take cognizance and issue guidelines and orders in this regard so that the trees are stopped from cutting and natural ecosystem is preserved and also the profit aim of Government is not hampered. It is only the last hope of the people of India and we look towards the Hon’ble Supreme Court for our lives guaranteed to us by the Constitution of India. If no measure is taken Genocide on a very large scale would prevail and no efforts like today will be available for rectification of the problem. Precaution is better than cure and hence we should today stand together and not let any such situation occur in future for which thousands of lives shall again be put to stake.
13. That, under the influence of Big multinational companies where profit making is the only aim of such organizations the Government is right now allotting the extraction rights and the contract to companies for cutting down of trees. Either due to lack of knowledge or due to Covid-19 the same cannot be communicated to the judiciary or hence, the Judiciary even being the protector of the rights of citizens of India fails to take its cognizance. It is therefore, totally in the interest of justice and for common objective of national interest that some action must be taken in this regard.
14. That, It is thereby, requested Collectively by every member and citizen of India and also by the collective efforts of Sanatan Rakshak Sansthan, Adarsh Sangram Party, and Vyom India parivar to stand against the unlawful cutting down of trees. Hence is communicating the message in a peaceful way to take the necessary steps otherwise, Judiciary shall be the only last ray of Hope and this movement shall be carried on by the public on a even greater scale, but we shall all protect the Nature and Tress as in History was done by Chipko Movement .
Therefore, It is respectfully and very humbly requested to take cognizance of the matter seriously and look back to the environment once again with deep concern and remind the things taught in school and protect the trees rather than cutting down of trees for selfish needs of some companies alone. Kindly take the required steps and communicate the proceedings as soon as possible.
