For those who may think that low income/affordable housing is an issue that will not directly impact them merely because any proposed low income project may not be located in their immediate neighborhood, you may be interested to read the Moorestown Resolution #74-2016 from March 28, 2016, which appears to start the process for development of another site for low income housing at the so-called "Maybury Tract", located at 600 Westfield Road, Moorestown. I have cut and pasted the Resolution (in the exact form I found on the Moorestown Township Government web-site) below. My interpretation of this Resolution is that in addition to starting the process for the 200 Hartford Road site, it also starts the process for the Maybury Tract. You may want to get involved in this issue, because your neighborhood could be next. Again, because the Council has not been transparent on this issue, the Moorestown residents with concerns have not been provided any relevant and material information on this subject. This update is not intended to unnecessarily alarm anyone, merely provide information as it is obtained by the author of this Petition. I came across this Resolution while researching the "low income housing" plans and obligations in our town. TOWNSHIP OF MOORESTOWN COUNTY OF BURLINGTON, NJ RESOLUTION NO. 74-2016 AUTHORIZING THE TOWNSHIP OF MOORESTOWN PLANNING BOARD TO UNDERTAKE A PRELIMINARY INVESTIGATION TO DETERMINE WHETHER BLOCK 5800, LOT 47 (MAYBURY TRACT) AND BLOCK 7401, LOT 3 (NAGLE TRACT), QUALIFY AS AREAS IN NEED OF NON-CONDEMNATION REDEVELOPMENT PURSUANT TO N.J.S.A. 40A:12A-5. WHEREAS, the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq. provides a mechanism to assist local governments in efforts to promote programs of redevelopment; and WHEREAS, the Local Redevelopment and Housing Law sets forth the procedures for the Township of Moorestown to declare areas in need of redevelopment, along with the development and effectuation of a redevelopment plan; and WHEREAS, pursuant to the required redevelopment procedures, specifically set forth in N.J.S.A. 40A:12A-6, no area of a municipality shall be determined a redevelopment area unless the governing body of the municipality shall, by resolution, authorize the Planning Board to undertake a preliminary investigation to determine whether a proposed area is a redevelopment area meeting the criteria set forth in N.J.S.A. 40A:12A-5; and WHEREAS, the Township Council finds it to be in the best interest of the Township and its residents to authorize the Township's Planning Board to undertake such preliminary investigation of the study areas as shown on the maps attached hereto as a Non-Condemnation Redevelopment Area in aid of the municipality’s affordable housing obligations; and WHEREAS, the Township Council desires the Planning Board to undertake preliminary investigations to determine whether the proposed study areas, which include Block 5800, Lot 47 and Block 7401, Lot 3, qualify as Areas in Need of Non-Condemnation Redevelopment pursuant to N.J.S.A. 40A:12A-5. NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of Moorestown, in the County of Burlington, and State of New Jersey, that the Planning Board is hereby authorized to undertake a preliminary investigation, utilizing Clarke Caton Hintz, P.C., affordable housing consultants to the municipality, to prepare the preliminary investigation, pursuant to the notice, conduct a hearing and comply with other requirements of the Redevelopment Law, N.J.S.A. 40A:12A-1, et seq., as amended, in order to recommend to the Township Council whether the area comprising the study area as shown on the maps attached hereto are an Areas in Need of Non-Condemnation Redevelopment according to the criteria set forth in N.J.S.A. 40A:12A-5. BE IT FURTHER RESOLVED that, pursuant to New Jersey P.L. 2013, Chapter 159, the redevelopment area determination shall authorize the Township to use all those powers provided by the Legislature for use in a Non-Condemnation Redevelopment Area. BE IT FURTHER RESOLVED that the Planning Board shall submit its findings and recommendations to the Township Council in the form of a Resolution with supporting documentation. BE IT FURTHER RESOLVED that a copy of this Resolution shall be forwarded to the Planning Board of the Township of Moorestown. Certified to be a true and correct copy of a resolution adopted by the Township Council of the Township of Moorestown at its meeting of March 7, 2016. ___________________________________ Patricia L.
